New York Courts Request Public Comments on Mandatory Electronic Filing Proposal

Chief Administrative Judge Joseph A. Zayas, J.S.C., is soliciting public comments regarding the proposal to authorize mandatory e-filing in New York State Courts’ Electronic Filing System (“NYSCEF”).

The proposal would implement mandatory e-filing for all new probate, administration, and miscellaneous proceedings in the Surrogate’s Court of Bronx, Kings, Queens, and Richmond Counties. This would mandate e-filing in 61 of the 62 Surrogate’s Courts statewide, with New York County as the only exception. The proposed implementation, if approved, will take effect on or around June 30, 2026.

Persons wishing to comment on this proposal should e-mail their submissions to efilingcomments@nycourts.gov no later than June 24, 2026.

Request for Comments – Annual E-Filing (NYSCEF) Report

Christopher Gibson, Director, Division of E-Filing, NYS Office of Court Administration, shared the following request for comments:

In preparation of the Office of Court Administration’s annual report on e-filing, to be submitted to the Chief Judge, the Governor, and the Legislature, we seek comments from the public addressing users’ experience with NYSCEF. Observations/recommendations are welcome from attorneys, litigants, and other interested parties. 

To allow sufficient time for report preparation, please submit any comments by February 13, 2026.

Expansion of Mandatory Electronic Filing in the Supreme Court – Civil Term

Christopher Gibson, Director, Division of E-Filing, NYS Office of Court Administration, shared the following announcement:

Please be advised that a memorandum from Hon. Joseph A. Zayas, J.S.C., Chief Administrative Judge, outlining the proposed statewide expansion of mandatory electronic filing (e-filing) in the Supreme Court – Civil Term has been posted online.

In accordance with Section 212 of the Judiciary Law, the Chief Administrative Judge of the State of New York will submit to the Legislature, the Governor, and the Chief Judge in April 2017 a report evaluating the state’s experience with electronic filing for the commencement of actions and proceedings and the service and filing of papers therein and containing such recommendations for further legislation as are deemed appropriate.  The report will also contain an evaluation of the impact of e-filing on litigants (including the unrepresented), practitioners, and the courts.  The Unified Court System welcomes the submission of comments about the implementation and impact of the electronic filing program from persons who are interested in or who have been or may be affected by the program, including unrepresented litigants, sole practitioners, 18 B attorneys, other attorneys, representatives of victims’ rights organizations and child protective agencies, criminal and Family Court practitioners, and others in the civil and criminal justice and Family Court communities.  Comments received will be posted on the website of the Court System and included in the report.  The report will also address such comments. 

Comments should be submitted to Jeffrey Carucci, Statewide Coordinator for Electronic Filing, on or before March 23, 2017.  Comments should be sent by e-mail or regular mail to one of the following addresses:
