NYForward: A Guide to Reopening New York

NYForward is a state mandated guide to reopening New York safely. The guide has addressed some of the critical factors that have have helped New Yorkers combat the spread of the Covid-19: statewide testing initiatives, economic stimulus packages, and maintenance of strategic reserve of personal protective equipment (PPE). As for guidelines moving forward, the guide has proposed a series of metrics by which regions would be evaluated to determine if they can reopen. These guidelines include a sufficiently low infection rate, a stable health care system that is able to absorb a potential resurgence in cases, sufficient diagnostic testing capacity, and robust contact-tracing to help prevent the spread of the virus. Additionally, the guide has provided a plan for the phased reopening of businesses.

The guide also urges community leaders to pay special attention to vulnerable populations and to hold businesses accountable to the listed guidelines. Universities and schools should craft individualized plans for reopening and state and local leaders should continue to provide sufficient mental health resources. The guide also outlines the individual responsibilities necessary for communities to curb the spread of the virus and stresses the importance of continuing social distancing policies along with practicing good hygiene.

The final section discusses lessons that can be learned from the current crisis and proactive measures that could be adopted. These policies include incorporating and integrating technology that could help schools better transition to online lessons, streamlining healthcare and transportation systems, and ensuring greater social equity through reforming housing policies and other initiatives.

March 20, 2020 Executive Order No. 202.8 from Governor Cuomo (Link)

“[A]ny specific time limit for the commencement, filing, or service of any legal action, notice, motion, or other process or proceeding, as prescribed by the procedural laws of the state, including but not limited to the criminal procedure law, the family court act, the civil practice law and rules, the court of claims act, the surrogate’s court procedure act, and the uniform court acts, or by any other statute, local law, ordinance, order, rule, or regulation, or part thereof, is hereby tolled from the date of this executive order until April 19, 2020”

Executive Order 202.8 directs a 100% in-person workforce reduction as of March 22, 2020 at 8:00 p.m. for “non-essential” services. Law firms have not been identified on the Executive Order or the Governor’s guidances as “essential.” Please see the NYSBA’s summary of the Executive Order here.

From the Chief Administrative Judge: Procedures to Reduce Courthouse Traffic

On March 13, Chief Administrative Judge Lawrence Marks issued a memorandum about procedures necessitated by the current coronavirus pandemic. The memorandum announced changes to civil court proceedings to reduce courthouse traffic, in line with recent actions from Governor Cuomo restricting large gatherings as a way to combat the spread of coronavirus. Effective this Monday, March 16, civil jury trials in which opening statements have not yet been made will be postponed until further notice, and civil jury trials that have already commenced will continue to conclusion.

The Unified Court System is constructing policy around prioritizing the health and safety of both their employees but also the general public, with a “goal of minimizing courthouse appearances, maximizing adjournments and stipulations on consent, and directing remote appearances through Skype or telephone.”

Other important matters that are highlighted in the Memorandum state that the New York City Housing Court will decline to issue eviction warrants if the parties do not appear in court and that all non-essential UCS travel is prohibited until further notice.

Governor Andrew M. Cuomo today signed legislation that begins the process of bringing New York State’s voting laws into the 21st Century, a central goal of his 2019 Justice Agenda for the first 100 days of the new legislative session. These historic new laws will allow for eight days of early voting before an election, synchronize federal and state primary elections, allow voter preregistration for teenagers, provide voter registration portability within the state, and close the LLC loophole.

For Championing LGBTQ Rights and Leading the Fight for Marriage Equality, Governor Issues Proclamation on Her Birthday, June 20

Governor Andrew M. Cuomo today proclaimed June 20 Edie Windsor Day in New York State as a tribute to her legacy championing equality and justice for the LGBTQ community, and for being on the front lines of the fight for marriage equality. Today would have been Edie’s 89th birthday.

“Edie was an iconic New Yorker who shaped history and taught us that love always wins,” Governor Cuomo said. “Proclaiming her birthday as Edie Windsor Day is a fitting way to salute a true New York hero whose strength, perseverance, and conviction in the face of adversity continues to inspire all of us.”

Whereas, all New Yorkers are proud to join in honoring the life and legacy of Edie Windsor, a pioneer and icon in the LGBTQ movement who inspired New Yorkers and people around the world through her courage, leadership, and tireless commitment to ensuring equality and justice; and

Whereas, throughout her extraordinary life, Edie broke down barriers – in her professional career working with early mainframe computers, having achieved the highest technical position of Senior Systems Programmer at IBM and, through her personal drive as a powerful and fearless voice for the LGBTQ community in New York and across the nation; and

Whereas, her landmark victory in United States v. Windsor marked a watershed in the movement to secure marriage rights for same-sex couples and paved the way for nationwide marriage equality; and

Whereas, Edie’s strength, perseverance, and conviction in the face of adversity has made her a hero to all New Yorkers and an invaluable inspiration to countless others in the fight for equality; and

Whereas, June 20, 2018 marks what would have been Edie’s 89th birthday, and all New Yorkers are proud to join in honoring and remembering Edie’s extraordinary life, her legacy of groundbreaking leadership, and her lasting contributions to equality everywhere;

What Is the Empire State Immigrant Defense Fund?

On January 9, Governor Cuomo presented the 12th Proposal of the 2017 State of the State Agenda to launch the “New York Promise” Agenda – a sweeping, unprecedented package of reforms to advance principles of social justice, affirm New York’s progressive values, and set a national standard for protections against all forms of discrimination. 

One of the objectives of the Agenda is the “We Are All Immigrants” Initiative which is being launched to expand opportunity and empower immigrants in New York. It features a comprehensive package of proposals, including the Empire State Immigrant Defense Fund. Governor Cuomo will launch this first-in-the-nation, state-led, public-private legal defense project to ensure that all New Yorkers have access to representation and due process, regardless of their citizenship status. This initiative will be administered by the State’s Office for New Americans in partnership with advocacy organizations, major colleges and universities, law firms, and legal associations around the state.
