Opinion | Tom Brokaw: Friends Across Barbed Wire and Politics

On August 11, the day after AABANY’s reenactment of the Heart Mountain draft resisters trial at Fordham Law School as part of the ABA’s CLE in the City Series, the New York Times published an Op-Ed by Tom Brokaw about the friendship struck between Alan Simpson and Norman Mineta. Simpson was a U.S. Senator representing Wyoming and Mineta served as U.S. Secretary of Transportation under President George W. Bush. They first met when Mineta and his family were interned at Heart Mountain.

Marking the 75th anniversary of Executive Order 9066 which led to the mass internment of Japanese American citizens without due process, Brokaw reminds us:

The senator likes to recall the words of Justice Frank Murphy, one of only three dissenting votes when President Roosevelt’s Executive Order 9066 was upheld by the United States Supreme Court in 1944. Justice Murphy wrote that “the broad provisions of the Bill of Rights” are not “suspended by the mere existence of a state of war. Distinctions based on color and ancestry are utterly inconsistent with our traditions and ideals.”

Let us continue to learn the lessons of the Japanese American internment experience during this 75th year anniversary of Executive Order 9066 so that we as a society can prevent future violations of constitutional and civil rights.

AABANY at the Trial of Two Pizzas and the Heart Mountain Trial Reenactment

At the Trial of Two Pizzas, to be held during the ABA Annual Meeting in New York City starting on August 10, an old rivalry will be put to rest at last. Both New York thin crust pizza and Chicago deep dish pizza are well-loved, but only one can be the best. Presided by AABANY-member Hon. Doris Ling-Cohan, the Trial of Two Pizzas will take place at the New York Hilton Midtown on Thursday, August 10th. 

The Trial of Two Pizzas is included in the CLE in the City Series, as part of the ABA Annual Meeting. Both ABA and non-ABA members can sign up for just $25 per program, and every program comes with access to the Trial of Two Pizzas on August 10th. 

Beyond the Trial of Two Pizzas, CLE in the City participants can partake in programs from twelve ABA tracks on topics ranging from family law to the United Nations, from Thursday, August 10th to Friday, August 11th. The internment of Japanese-American citizens during the Second World War will forever remain a painful chapter our nation’s history. When the U.S. government began drafting interned citizens for military service in 1944, a group of men confined at Wyoming’s Heart Mountain Relocation Center protested their loss of freedom through a mass draft evasion. Experts lead a trial reenactment of the legal proceedings that followed and share the draft resisters’ story through narration, discussion, and historic photographs.

Trial Reenactment Cast includes:
Denny Chin is a United States Circuit Judge for the United States Court of Appeals for the Second Circuit and the former President of the Asian American Bar Association of New York. The Asian American Bar Association of New York is a nonprofit corporation that represents the interests of New York Asian-American legal professionals and law students. They seek to improve the study and practice of law, and the fair administration of justice for all by ensuring the meaningful participation of Asian-Americans in the legal profession.

Bar Uses Historical Reenactments as ‘Teaching Tool’

A roomful of attorneys was transported last Thursday to the early 1940s, when Japanese-Americans on the West Coast were forced from their homes and into internment camps, but could still be drafted to fight for the country that had stripped them of their constitutional rights.

The New York Law Journal covered the AABANY re-enactment of the Heart Mountain trials presented on July 11 at Cadwalader. AABANY again thanks Cadwalader for hosting the event, helping AABANY to inform and educate the public about important civil rights and social justice issues in American history raised by Asian Americans and their experience.

Cadwalader to Shed Light on World War II Draft Resister Case

NEW YORK, July 11, 2013 /PRNewswire/ – Cadwalader, Wickersham & Taft LLP (Cadwalader), a leading counselor to global financial institutions and corporations, is hosting a unique event that will reenact the historic World War II case of the 63 Japanese-American draft resisters who were interned at Heart Mountain in Wyoming and refused to report for U.S. military service until their rights as citizens were restored.
