AABANY Applauds Nomination of Kathy Hirata Chin for New York Court of Appeals Vacancy

NEW YORK – December 18, 2014 – The Asian American Bar Association of New York (“AABANY”) is proud to announce that the Commission on Judicial Nominations has named Kathy Hirata Chin (Partner at Cadwalader, Wickersham, & Taft LLP) as one of seven well-qualified nominees for the judgeship vacancy on the New York State Court of Appeals created by the retirement of Judge Robert Smith. The Commission on Judicial Nomination, charged with evaluating and recommending to the Governor candidates to fill vacancies on the New York Court of Appeals, the state’s highest court, received 53 applications and interviewed 22 candidates for the Smith opening.

“AABANY applauds the Commission on Judicial Nomination for its recommendation of Kathy Hirata Chin to join the highest court of New York and strongly encourages Governor Cuomo to make history by appointing the first-ever Asian Pacific American (APA) judge to this esteemed institution,” said AABANY President Clara Ohr.  “Kathy’s qualifications would make her a valuable addition to this court and her appointment would be an important step toward making the judiciary in New York a more accurate reflection of the population it serves.” APAs remain significantly underrepresented in the New York Judiciary. With approximately 1300 judges in the New York State court system, only 22 of them are APAs in spite of the fact that APAs make up approximately 8% of the population of New York State.  

“We congratulate Kathy on her selection as a nominee to the State’s highest court,” said Linda Lin, Co-Chair of AABANY’s Judiciary Committee. “Her outstanding credentials, balanced temperament, and sterling achievements undoubtedly make her an excellent candidate for the bench and we strongly urge Governor Cuomo to appoint Kathy Chin to the New York Court of Appeals bench.”

Kathy Hirata Chin is an accomplished litigator who has handled dozens of appellate cases, concentrating her practice in healthcare and real estate. After graduating magna cum laude from Princeton University and graduating Columbia University School of Law, where she was a Harlan Fiske Stone Scholar and Editor-in-Chief of The Columbia Journal of Transnational Law, Ms. Chin joined Cadwalader, Wickersham & Taft LLP, becoming one of the first minority and women Partners in 1990. Nominated by Mayor Rudolph Giuliani, Ms. Chin served on the New York City Planning Commission from 1995-2001. Nominated by Mayor Michael R. Bloomberg, Ms. Chin has served on the New York City Commission to Combat Police Corruption since August 2003. She has also served on Governor Mario M. Cuomo’s Judicial Screening Committee for the First Judicial Department from1992-1994; the Magistrate Judge Merit Selection Panel for the Eastern District of New York from 1992-1999; the Gender Bias Committee of the Second Circuit Task Force on Gender, Race, and Ethnic Fairness; the New York County Lawyers’ Association’s Task Force to Increase Diversity in the Legal Profession; and Chief Judge Judith S. Kaye’s Commission to Promote Public Confidence in Judicial Elections from 2003-2006; and the New York County Lawyers’ Association Board of Directors. She currently serves as a member of The Attorney Emeritus Advisory Council and The Commercial Division Advisory Council, and as member of the Board of Directors of the Medicare Rights Center. Ms. Chin has been a longstanding and active member of AABANY.

What ever became of the 22 Chinese women that landed on the shores of San Francisco in 1874 only to be detained for their lewdness?

You might remember that on October 18, the Honorable Denny Chin and his wife Kathy Hirata Chin led yet another performance of the popular trial re-enactment “22 Lewd Chinese Women: A Trial Reenactment,” this time a shortened version at the New York Historical Society. Thanks to the resourcefulness of the New York Historical Society, we can bring you the gift of this podcast, which features not only many members of our AABANY cast, but also a question-and-answer session with Hon. Denny Chin, Kathy Hirata Chin, Vince Chang, and David Weinberg. For anyone who has not yet had their daily dose of human rights, sex trafficking, and federalism, we invite you to listen.

AABANY TO RECEIVE 2013 NEW YORK STATE CONFERENCE OF BAR LEADERS INNOVATION AWARD FOR “IVA: THE MYTH OF TOKYO ROSE” PROGRAM

NEW YORK – January 27, 2014 – The Asian American Bar Association of New York (“AABANY”) is proud to announce that it will receive a 2013 Bar Leaders Innovation Award for its Asian Pacific American Heritage Month production, “Iva: The Myth of Tokyo Rose.”  The award bestowed by the New York State Conference of Bar Leaders Executive Council of the New York State Bar Association recognizes bar associations that introduce new programs, ideas and methodologies that benefit its members and the community at large.  AABANY’s “Tokyo Rose” program was evaluated based on its ingenuity and creativity, effect on the bar and general public, and its overall quality.

“Iva: The Myth of Tokyo Rose,” which was co-produced by AABANY and the Asian American Arts Alliance (the “Alliance”), tells the story of Iva Toguri, a Japanese American citizen, who was accused of treason during World War II.  Original court transcripts were edited and compiled under the leadership of the Honorable Denny Chin and Kathy Hirata Chin.  This material was then adapted by playwright Soriya Chum and culminated in a production addressing issues concerning race, civil rights, prosecutorial abuse and social injustice.  “Tokyo Rose” was directed by Soriya Chum and Elena Chang and performed on stage at the Asia Society in New York City on May 16-17, 2013.  Following the performances, talkbacks were held with esteemed speakers and guests, including the Honorable Denny Chin (U.S. Court of Appeals, Second Circuit), Kathy Hirata Chin (Cadwalader, Wickersham & Taft LLP), Gurjot Kaur (Sikh Coalition), Andrea Louie (the Alliance), Yang Chen (AABANY), Rehana Mirza (Ma-Yi Theater’s Writer’s Lab) and Eileen Rivera (Leviathan Lab).

The New York State Conference of Bar Leaders will honor AABANY along with its sister bar associations for their innovative programs at the Annual Breakfast for Bar Leaders to be held at the Hilton New York Midtown on Friday, January 31, 2014.  “On behalf of AABANY, we thank the New York State Conference of Bar Leaders for this prestigious award and recognizing our continuing efforts to produce programs that address significant legal issues and social matters of importance to our members and the Asian Pacific American community as a whole,” said Mike Huang, AABANY’s President.

AABANY turned out in force for the 25th annual NAPABA National Convention in Kansas City, Missouri.

Among the highlights was the highly popular trial re-enactment “22 Lewd Chinese Women: Chy Lung v. Freeman,” led by Hon. Denny Chin and Kathy Hirata Chin, with a cast that included AABANY members Vince Chang, Yang Chen, Theo Cheng, Francis Chin, Andy Hahn, Lauren U.Y. Lee, Linda Lin, Anna R. Mercado, Vinoo Varghese, Ona T. Wang, and Jessica C. Wong.

Other speakers from AABANY during the convention included: Hon. Pamela K.M. Chen, James R. Cho, Hon. Doris Ling-Cohan, Don Liu, Hugh H. Mo, Chul Pak, Sapna Palla, Helen Wan, Michael Wu, Pauline Yeung-Ha, Michael Yim and James Yu.

AABANY congratulates its Best Under 40 Award Recipients, Mike Huang, Michael Park and Asim Rehman.

All the attendees enjoyed terrific program offerings, well-attended social events, sightseeing excursions, re-connecting with old friends, making new ones, and plenty of barbeque.

Next year’s convention will be held in Scottsdale, Arizona, Nov. 6-9, 2014.

Cadwalader to Shed Light on World War II Draft Resister Case

NEW YORK, July 11, 2013 /PRNewswire/ – Cadwalader, Wickersham & Taft LLP (Cadwalader), a leading counselor to global financial institutions and corporations, is hosting a unique event that will reenact the historic World War II case of the 63 Japanese-American draft resisters who were interned at Heart Mountain in Wyoming and refused to report for U.S. military service until their rights as citizens were restored.

The group develops and performs reenactments of important moments in Asian American legal history, which are first performed at the annual National Asian Pacific American Bar Association (NAPABA) convention in November. The Hon. Denny Chin, Judge for the United States Court of Appeals for the Second Circuit, and the Hon. Kiyo Matsumoto, Judge for the United States District Court for the Eastern District of New York, will also participate in the evening’s program.
