NAPABA Statement on the U.S. Supreme Court’s Affirmative Action Decision

WASHINGTON – The National Asian Pacific American Bar Association (“NAPABA”) is disappointed in the United States Supreme Court’s decision today in Students for Fair Admissions v. Harvard and Students for Fair Admissions v. University of North Carolina, which held that the consideration of race, as one factor among many in a holistic college admissions process, violates the Equal Protection Clause of the Fourteenth Amendment. With colleges and universities acting as incubators for the future leaders of the Nation, the decision now places an obstacle to achieving diversity, equity, and inclusion in the pipelines of leadership.

As detailed in A Portrait of Asian Americans in the Law 2.0: Identity and Action in Challenging Times (Portrait Project 2.0) published by the American Bar Foundation and NAPABA, we know that though the Asian American, Native Hawaiian, and Pacific Islander community has seen progress in some areas, underrepresentation of our community in the top ranks of the legal profession persists. Portrait Project 2.0, along with NAPABA’s amicus brief with the Court, highlighted the continuing need to advance diversity efforts in the legal profession, where the AANHPI community, along with all communities of color, struggle to achieve success.

At bottom, the Court’s decision today places an impediment to efforts to diversify the legal pipeline at its early stages, the college admissions process. Despite the ruling, NAPABA remains committed to its long-standing values. Whether advancing our leadership and mentorship programs, working with the private sector, government, and public interest stakeholders, or through our partnership with the law student community, NAPABA remains acutely focused to ensure that the profession and leadership reflect the communities that they serve and that the AANHPI community is meaningfully represented.

The National Asian Pacific American Bar Association (NAPABA), in collaboration with the American Bar Foundation, is proud to announce the release of A Portrait of Asian Americans in the Law 2.0: Identity and Action in Challenging Times (Portrait Project 2.0). Building on the results of the original Portrait Project report published in 2017, this five-year follow-up study provides comprehensive data and analysis on the progress and experiences of Asian Americans in the legal profession.

“Portrait Project 2.0 is a crucial resource for lawyers, policymakers, researchers, and advocates seeking to advance diversity in the legal profession,” said Sandra Leung, president of NAPABA. “By spotlighting the experiences of Asian American attorneys, this new report calls attention to our community’s successes and challenges, and provides troves of data that will inform efforts to promote equity and inclusion in a variety of sectors and organizations. We are proud that this report quantifies the advances we have made on the bench and in the C-Suite. However, we recognize that Asian Americans remain underrepresented in the highest ranks of law firms, education, and in public service and commit to investing in career development in those sectors.”

“The findings of Portrait Project 2.0 highlight the importance of NAPABA’s ongoing work to develop innovate programs to help attorneys at all stages of their career lifecycle, from law school to retirement, to advance and find personal fulfillment in their profession,” said Priya Purandare, executive director of NAPABA. “As we learned five years ago, legal employers and legal networks must make more strategic investments in supporting Asian American attorneys by facilitating relationship-building, helping young lawyers develop soft skills, and providing leadership opportunities. Further, they must invest in meaningful interventions that combat institutional bias and stereotypes. This report underscores the opportunity top organizations across sectors have to attract and retain top-talent by creating supportive and value driven cultures.”

The 77-page report — authored by Tyler Dang, Katherine Fang, Benji Lu, Michael Tayag, and California Supreme Court Justice Goodwin Liu — combines detailed analysis of employment data in various legal sectors with qualitative insights from focus groups and results of a wide-ranging national survey completed by over 700 Asian American lawyers.

This five-year update offers fresh insights into Asian American career advancement and political participation against the backdrop of a rise in anti-Asian hate. Among the key findings:

  • Asian American attorneys indicated greater engagement with social and political issues. Those seeking to change practice settings ranked a desire to advance issues important to them among their most significant reasons for doing so. This was ranked among the least significant reasons in 2016.
  • 47% of survey respondents reported having become more involved in community organizations, protests, or other forms of advocacy on behalf of Asian Americans since March 2020, suggesting recent societal events may be influenced this behavior.
  • There has been progress in the appointment of federal judges and in the ranks of general counsel. The number of Asian American federal judges has increased over the past five years, comprising 6% of active federal judges compared to 3.4% in 2016.
  • Underrepresentation of Asian Americans in the top ranks of the legal profession persists. Asian Americans are the largest minority group at major law firms, but they have the lowest ratio of partners to associates — and the highest attrition rate. Further, they remain underrepresented among law clerks, law professors, state court judges, and state and federal prosecutors.
  • Asian American attorneys would likely benefit from greater institutional supports that counteract stereotypes and facilitate relationship-building and leadership opportunities.

AABANY Celebrates 2021 Virtual Gala

On Wednesday, February 24, 2021, AABANY hosted its 2021 Virtual Gala: Uniting for Justice and Equity. 

The event kicked off at 6 pm with a Pre-Gala Virtual Cocktail Reception on Remo attended by sponsors and special guests, including prominent General Counsels and judges. At 6:30 pm, all Virtual Gala attendees were invited to enjoy a piano concert featuring AABANY Member Renee Yao.

The Virtual Gala started at 7 pm and Kate Siahaan-Riggs, NYC-based actor, stand up comic, and writer, served as emcee. Throughout the gala, AABANY held a text-to-donate fundraiser to support Portrait Project 2.0, the second phase of the Portrait Project study which is researching why Asian Americans are underrepresented in top leadership positions across all sectors of the legal profession and how it can be addressed.

Ed Lee, AABANY Board Director and Partner at Kirkland & Ellis, accepted the Law Firm Diversity Award on behalf of Kirkland & Ellis LLP. Honoree Sneha Desai delivered an acceptance speech, stressing the importance of individuals in leadership and influential positions to make positive change in diversity and inclusion. The Honorable Denny Chin, U.S. Circuit Judge, U.S. Court of Appeals, 2nd Circuit, hosted a fireside chat with honoree Frank H,. Wu to discuss his career and the work he has accomplished.

In addition, we were also pleased to present the 2021 class of Don H. Liu Scholars: Narissa Ganpat, Minji Kim, and Minh Eric Le.

The Gala concluded with a tribute to Asian American photojournalist and historian Corky Lee who passed away in January due to COVID-19. Corky had taken photos of our past Annual Dinners from its earliest days until 2020.

Join AABANY in Supporting Portrait Project 2.0

A recent Law360 article entitled “Why Are Law Clerks So White” reported:

Take any five federal law clerks, and at least four of them would probably be white. And nobody can be certain why.

California Supreme Court Justice Goodwin Liu has some guesses about the reasons black, Asian and Latino lawyers are largely shut out of these prestigious positions that can turbocharge a lawyer’s early career. But he says it’s impossible to pinpoint reasons or patterns because so little data exists.

“We actually don’t even know the most basic things about those opportunities,” Justice Liu told Law360. “It would be interesting if we could know even basic things, like do women judges get more women clerks? We have impressions of that, but we don’t know with any precision whether these things are true.”
