In the News: Litigation Committee Co-Chair Luna Barrington Named Top Lawyer under 40 by Law360 Rising Stars

Out of over 1,400 submissions, AABANY Litigation Committee Co-Chair Luna Barrington has been recognized by Law360 as one of this year’s Rising Stars under 40, as she has secured defense trial verdicts in major class action suits against companies like C&S Wholesale Grocers and Johnson & Johnson. On June 4, Law360 published an article highlighting her recent accomplishments as a trial attorney, underscoring the massive damages she saved her clients by skillfully preparing for and conducting the trial with her trial team. Now a partner at Weil Gotshal & Manges LLP, she recalls successfully advocating for a group of Mexican-American students in Tucson, AZ, pro bono, as among the proudest moments of her career: in federal court, Barrington fought a state statute banning a Mexican-American studies program in Tucson’s schools, denouncing it as a violation of the First and Fourteenth Amendments. She is also a first-generation lawyer and the first in her family to earn a graduate degree. AABANY Statement on the Verdict in the Trial of Derek Chauvin

In the wake of the deaths of George Floyd, Ahmaud Arbery, and Breonna Taylor in 2020, the Asian American Bar Association of New York (AABANY) expressed solidarity with the Black community. On April 20, 2021, a jury in Minneapolis convicted Derek Chauvin on all counts in the killing of George Floyd. AABANY recognizes this guilty verdict as only a first step towards fighting for a future where justice prevails. AABANY acknowledges the longstanding history of systemic injustice faced by the Black community, and we realize how far we all need to go to build a better, more equitable society. This trial should stand as a significant marker of a pivotal point in our history in which police accountability and racial justice emerge as important measures of how our democracy has made progress.

AABANY’s theme this year is “Uniting for Justice and Equity.” As we work to promote diversity, equity and inclusion, and continue our struggle against racism, discrimination, xenophobia, and hate crimes, AABANY stands steadfast in its solidarity with the Black community. When the justice system fails to protect the civil liberties and human rights of the Black community, everyone suffers. Together, we must raise our voices against injustice and call for overdue reform in the criminal justice system.

MNAPABA and NAPABA Statement on the Verdict in the Trial of Derek Chauvin

Over the past year, in the wake of the tragic deaths of George Floyd, Ahmaud Arbery, and Breonna Taylor, amongst others, MNAPABA and NAPABA expressed their support of and solidarity with the Black community in Minnesota and across the nation.  Today, a jury in Minneapolis has convicted Derek Chauvin on all counts charged in the killing of George Floyd. MNAPABA and NAPABA acknowledge the pain and anguish of the Floyd family and the Black community, and we recognize this is but one chapter in the ongoing endeavor to improve accountability, training, integrity, transparency, and improvement of this country’s criminal justice system as we have called for in NAPABA’s Resolution in Support of the Black Community.

At this critical inflection point in race relations in the United States, and as our own communities face a surge in reported hate crimes and bias-motivated incidents, MNAPABA and NAPABA reiterate their commitment to stand in solidarity with the Black community in Minnesota and across the nation in our shared goal of combating racism, discrimination, hate crimes, and other forms of bigotry. NAPABA recognizes the long history of systemic inequality faced by the Black community in this country and reaffirms its resolution calling for accountability and improving standards of professionalism and conduct in law enforcement. NAPABA has called for building trust between law enforcement and communities of color including by promoting diversity, inclusion, and better training for law enforcement. Community and government leaders must work together to create that trust and fairness in the legal system by combatting bias and safeguarding civil rights, civil liberties, and access to justice for all. While there remains much more work to be done, we hope this outcome helps the country heal and put greater faith in the rule of law.

The 2013 NAPABA Northeast Regional/AABANY Fall Conference hosted by Weil Gotshal featured a packed afternoon with several CLEs to keep attendees busy. Session 3 commenced at 2:30 pm and CLE topics included: “How do GCs Manage Crisis and Government Investigations,” “E-discovery and the New Ethical Rules for Non-Litigators,” “The Right to Vote: Asian Americans and the Struggle Over who Can Vote and How,” and much more, including the afternoon portion of the all-day Trial Advocacy Program (TAP).

“How do GCs Manage Crisis and Government Investigations” was one of our most popular CLE programs. The panel was moderated by Don Liu, Corporate Senior Vice President, General Counsel and Secretary at Xerox. Panelists included Stuart Alderoty, Senior Executive Vice President and General Counsel at HSBC, Bruce Bettigole, Partner at Sutherland, Katy Choo, Chief Investigative & Anti-Corruption Counsel at General Electric, and Sandra Leung, General Counsel and Corporate Secretary at Bristol-Myers Squibb.

Session 4 started at 4PM with well-attended CLEs: “The Partner Track: Fiction v. Reality,” “Common Sense Immigration Reform,” and “General Counsel Roundtable.”

Outside of the CLE programs, Robert Leung, Michael Park, and Gurinder Singh, of the newly formed AABANY Career Placement Committee, held one-on-one meetings throughout the day, in the morning and afternoon, with many individuals interested in the participating in the committee and the AABANY Career Exchange.

Bar Uses Historical Reenactments as ‘Teaching Tool’

A roomful of attorneys was transported last Thursday to the early 1940s, when Japanese-Americans on the West Coast were forced from their homes and into internment camps, but could still be drafted to fight for the country that had stripped them of their constitutional rights.

The New York Law Journal covered the AABANY re-enactment of the Heart Mountain trials presented on July 11 at Cadwalader. AABANY again thanks Cadwalader for hosting the event, helping AABANY to inform and educate the public about important civil rights and social justice issues in American history raised by Asian Americans and their experience.

Cadwalader to Shed Light on World War II Draft Resister Case

NEW YORK, July 11, 2013 /PRNewswire/ – Cadwalader, Wickersham & Taft LLP (Cadwalader), a leading counselor to global financial institutions and corporations, is hosting a unique event that will reenact the historic World War II case of the 63 Japanese-American draft resisters who were interned at Heart Mountain in Wyoming and refused to report for U.S. military service until their rights as citizens were restored.

The program will be presented by a team of Asian American Bar Association of New York (AABANY) members, which includes Cadwalader Partner Kathy Hirata Chin and Special Counsel Lauren U.Y. Lee. The group develops and performs reenactments of important moments in Asian American legal history, which are first performed at the annual National Asian Pacific American Bar Association (NAPABA) convention in November. The Hon. Denny Chin, Judge for the United States Court of Appeals for the Second Circuit, and the Hon. Kiyo Matsumoto, Judge for the United States District Court for the Eastern District of New York, will also participate in the evening’s program.
