NAPABA Applauds the Confirmation of Sharad Desai to the U.S. District Court for the District of Arizona

WASHINGTON – Today, the United States Senate confirmed Sharad Desai to the U.S. District Court for the District of Arizona. Mr. Desai is the first Asian American Article III judge to serve in the District of Arizona.

“NAPABA applauds the historic confirmation of Sharad Desai,” said Thy Bui, President of NAPABA. “An active member of the community and an advocate of diversity and inclusion, Mr. Desai brings experiential diversity as an in-house counsel to a District where the AANHPI population has grown over 50 percent over the last decade.”

Sharad H. Desai has been Vice President and General Counsel for Honeywell International’s Integrated Supply Chain and Information Technology divisions in Phoenix, Arizona, since 2023. He has worked in senior legal counsel roles at Honeywell since 2015. From 2007 to 2015, Mr. Desai worked as an attorney with the Phoenix law firm Osborn Maledon, P.A., first as an associate and later as a partner. He began his legal career as a law clerk for Justice Rebecca White Berch on the Arizona Supreme Court from 2006 to 2007. Mr. Desai received his J.D. from New York University School of Law in 2006 and his B.A. and B.S. from the University of Arizona in 2003.

“Nearly 20% of President Biden’s confirmed Article III judges are AANHPI,” said Priya Purandare, Executive Director of NAPABA. “Today, 40 AANHPI Article III judges have been confirmed during the Biden Administration, and 70 AANHPI active Article III judges are serving.”

WASHINGTON – Today, the United States Senate confirmed Amir H. Ali to the U.S. District Court for the District of Columbia.

“NAPABA congratulates Amir Ali on his confirmation to the U.S. District Court for the District of Columbia,” said Thy Bui, President of NAPABA. “Mr. Ali is an experienced civil rights litigator known for building coalitions, setting multiple landmark precedents at the U.S. Supreme Court and appellate courts that transcend ideology. NAPABA is proud to have supported his nomination.”

Amir H. Ali served as President and Executive Director of the MacArthur Justice Center from 2021-24 and Director of the Criminal Justice Appellate Clinic at Harvard Law School since 2018. Previously, Mr. Ali worked in private practice as an associate at Jenner & Block LLP in Washington, DC, from 2013-17. He also served as a law clerk for Justice Marshall Rothstein on the Supreme Court of Canada from 2012-13 and Judge Raymond C. Fisher on the U.S. Court of Appeals for the Ninth Circuit from 2011-12. Mr. Ali received his J.D., magna cum laude, from Harvard Law School in 2011 and his B.S.E. from the University of Waterloo in Ontario, Canada, in 2008.

“In President Biden’s single term, he has tied the number of AANHPI judges confirmed under the five terms of Presidents George W. Bush, Barack Obama, and Donald Trump,” said Priya Purandare, Executive Director of NAPABA. “Thirty-nine AANHPIs to Article III judges have been confirmed since 2021, and 69 AANHPI active Article III judges are serving.”

NAPABA Urges the U.S. Senate to Confirm Adeel Mangi to the U.S. Court of Appeals for the Third Circuit

WASHINGTON – Today, the National Asian Pacific American Bar Association (NAPABA) joined 125 national, state, and local organizations from across the country to urge the United States Senate to confirm Adeel Mangi swiftly to the U.S. Court of Appeals for the Third Circuit. In a letter spearheaded by the Leadership Conference on Civil and Human Rights, NAPABA and its partners highlighted Adeel Mangi’s exceptional qualifications and condemned “the baseless and bigoted attacks being waged against this exceptional and historic nominee.”

In November 2023, President Joe Biden nominated Mr. Mangi to the Third Circuit. If confirmed, Mangi would be the first Muslim American judge on any federal appellate court in the nation. As NAPABA noted when he was nominated, Mr. Mangi is a 2014 NAPABA Best Under 40 awardee and an active leader in the Asian American community. His long record of accomplishments, including his pro bono work supporting the Muslim American community, is groundbreaking.

“From the time that the President nominated Adeel Mangi nearly five months ago to today, nothing in Mr. Mangi’s tremendous record of achievements has changed,” said Anna Mercado Clark, President of NAPABA. “Instead, since his nomination, Mr. Mangi has been the subject of baseless attacks that smack of Islamophobia. Our community is all too familiar with the rise of hate, and what Mr. Mangi has had to endure is unacceptable. We urge the U.S. Senate to confirm his nomination.”

“The baseless attacks against Mr. Mangi have a chilling effect,” said Priya Purandare, Executive Director of NAPABA. “As we have raised in an op-ed and in a recent news article, Mr. Mangi’s treatment, if left unanswered, runs the risk of losing an entire generation of legal talent from entering public service and the opportunity to compose a federal bench that reflects the changing demographics of the United States. History will remember this moment. NAPABA stands behind Mr. Mangi’s nomination and looks forward to his confirmation.”

Adeel A. Mangi is a partner at Patterson Belknap Webb & Tyler LLP. He began his legal career there as an associate in 2000, became counsel in 2009, and was elevated to partnership in 2010. Mr. Mangi received his LL.M. from Harvard Law School in 2000. He qualified as a Barrister and received his Postgraduate Diploma in Professional Legal Skills from the City University London Inns of Court School of Law in 1999 and his First Class Degree in Law from the University of Oxford, Pembroke College, in 1998.

NAPABA Supports the John R. Lewis Voting Rights Advancement Act

WASHINGTON – The National Asian Pacific American Bar Association (NAPABA) applauds the United States Senate’s reintroduction of the John R. Lewis Voting Rights Advancement Act, a bill that would restore critical protections of the Voting Rights Act. Especially in a critical election year, Congress must ensure that everyone can fully participate in our democracy. This month, we commemorate the 59th anniversary of Bloody Sunday, when, on March 7, 1965, in Selma, Alabama, State Troopers attacked hundreds of unarmed protestors, including the civil rights leader John Lewis, who opposed the systematic oppression of Black voters. It led to the ultimate passage of the Voting Rights Act. As those activists knew then, and as we are reminded today, the right to vote is foundational, and as an organization advancing the interests of the AANHPI community, NAPABA realizes the critical importance for our community to have equal access to the ballot.  

“The endeavor to secure equal voting rights requires constant vigilance,” said Anna Mercado Clark, President of NAPABA. “The life and legacy of John Lewis are a powerful reminder of it. President Joe Biden nominated Captain Lia Mitoko Reynolds, United States Navy, to Deputy Judge Advocate General of the Navy (DJAG) with the rank of Rear Admiral (two stars). If confirmed, she would be the first AANHPI Flag Officer to serve in the United States Navy JAG Corps.

“NAPABA congratulates Captain Reynolds on her nomination. She is widely recognized as one of the top officers in the Navy Judge Advocate General’s Corps. In 2019, she was presented with the Burton Award for Public Service in the Military. NAPABA also awarded her the Military & Veteran Service Award in 2019,” said Anna Mercado Clark, President of NAPABA. “An active member of NAPABA, Captain Reynolds has served as a Navy JAG officer for 26 years. She is well qualified to serve as the Navy’s DJAG, and we urge the United States Senate to confirm her quickly.”

NAPABA Applauds the Confirmation of Susan Kim DeClercq to the U.S. District Court for the Eastern District of Michigan

Yesterday [October 4], the United States Senate confirmed Susan Kim DeClercq to serve on the United States District Court for the Eastern District of Michigan. Judge DeClercq is the first federal judge of East Asian descent in Michigan.

“NAPABA congratulates Susan DeClercq on her confirmation to the U.S. District Court for the Eastern District of Michigan, a district where nearly half of all AANHPIs in Michigan live,” said Sandra Leung, President of NAPABA. “The first federal judge of East Asian descent in Michigan, Judge DeClercq is an experienced prosecutor with experience in private practice and corporate law. NAPABA is proud to have supported her nomination to the bench.”

Susan K. DeClercq has been Director and Counsel of Special Investigations at Ford Motor Company in Dearborn, Michigan, since 2022. Judge DeClercq previously served as an Assistant U.S. Attorney and Chief of the Civil Division since March 2014. Before joining the U.S. Attorney’s Office in September 2004, Judge DeClercq was an associate at Skadden, Arps, Slate, Meagher, and Flom in Washington, D.C., and she clerked for Judge Avern Cohn on the U.S. District Court for the Eastern District of Michigan. Judge DeClercq received her J.D., magna cum laude, from Wayne State University School of Law in 1999 and her B.A. from the University of Michigan in 1995.

NAPABA Applauds the Confirmation of Justice Myong J. Joun to the U.S. District Court for the District of Massachusetts

WASHINGTON – Yesterday, the United States Senate confirmed Judge Myong J. Joun to the United States District Court for the District of Massachusetts. Judge Joun is the first Asian American male in Massachusetts to serve as an Article III judge.

“NAPABA congratulates Judge Myong Joun on his confirmation to the U.S. District Court,” said Sandra Leung, President of NAPABA. “An exceptional attorney and judge, Judge Joun is a leader in the community. A U.S. Army and Massachusetts National Guard veteran, he is the second former Asian American Lawyers Association of Massachusetts president to be confirmed to an Article III judgeship.”

Before Judge Joun’s confirmation, Governor Deval Patrick appointed him to the Boston Municipal Court. He worked in private practice, specializing in criminal defense and plaintiff’s civil rights litigation in state and federal courts.

Active in the community, Judge Joun is a former president of the Asian American Lawyers Association of Massachusetts, an affiliate of NAPABA. He has served on the boards of directors for the Harry J. Elam Judicial Conference, the National Lawyers Guild, the Lawyers’ Committee for Civil Rights Under Law of the Boston Bar Association, and the Executive Management Board of the Massachusetts Bar Association. Judge Joun received his J.D. from Suffolk Law School and his B.A. from the University of Massachusetts.

Statement On S. 937 COVID-19 Hate Crimes Act

Today, the United States Senate, in an overwhelmingly 94-1 bipartisan vote, passed S. 937, the “COVID-19 Hate Crimes Act” introduced by Senator Mazie Hirono (D-HI).  This legislation requires that the U.S. Department of Justice designate a point person whose sole responsibility is to facilitate the expedited review of hate crimes related to the COVID-19 pandemic. Notably, the legislation recognizes a “COVID-19 hate crime” as an act of violence motivated by the actual or perceived relationship to the spread of COVID-19 of any person based on their race, ethnicity, age, color, religion, national origin, sexual orientation, gender, gender identity, or disability. The Senate-passed legislation also incorporates the Jabara-Heyer No Hate Act which increases resources for hate crimes reporting and assistance for victims of hate crimes.

“NAPABA congratulates the Senate for passing this important legislation, and Senator Hirono for her leadership on this issue,” said NAPABA President A.B. Cruz III. “This bill squarely addresses one of the root causes of the increase in hate crimes and bias-motivated incidents being committed against the Asian American community – the dangerous rhetoric and falsehood that somehow Asian Americans are responsible for the COVID-pandemic. NAPABA is committed to ensuring justice for hate crimes and hate-motivated incidents committed against the Asian American community, and looks forward to swift passage in the House and enactment into the law.”

NAPABA believes this bill will help state and local law enforcement to better investigate and record hate crimes and hate incidents and prosecute them where appropriate. The legislation also requires the Department of Justice to issue guidance on establishing online hate crimes and hate incident reporting in multiple languages, and to work with the Department of Health and Human Services to issue guidance on best practices to mitigate discriminatory language in describing the COVID-19 pandemic.  In response to the surge in attacks against Asian Americans in the wake of the pandemic, NAPABA in partnership with the APIA Health Forum have produced a hate crimes reporting toolkit – translated into 25 languages and English – the single largest collection of different AAPI-language materials assembled, that provides basic and critical information for victims, community based organizations, and community leaders.

NAPABA Mourns the Death of Senator Daniel Inouye

Washington – The National Asian Pacific American Bar Association (NAPABA) mourns the death of Senator Daniel K. Inouye, the second-longest serving member of the United States Senate and the highest ranking Asian Pacific American in the nation. He was the first Japanese American to serve in Congress and a lifelong champion of civil liberties for all Americans.
