AABANY Judiciary Committee Holds Quarterly Meeting at NYC Civil Court

On Tuesday, July 17th, the Judiciary Committee held its quarterly meeting at NYC civil court located in Lower Manhattan. The meeting was led by Co-chairs Rena Malik and William Wang. During the meeting, the attendees heard about highlights of past events, such as the robing ceremony of Judge Michael Park, and also actively engaged in a discussion on how to prepare and improve future investiture ceremonies for prospective APA judges. The discussion also covered screening panel training for next spring and applications for AABANY endorsement for members who wish to ascend to the bench. After hearing about AABANY’s participation in screening panels in New York, several attendees kindly offered help to connect the committee with eligible speakers for the screening panel training. At the end of the meeting, the co-chairs and the attendees brainstormed possible topics on what should be presented at this year’s Fall Conference, which is being held in conjunction with the NAPABA Northeast Regional. They also proposed ideas of possible events in the future, such as a clerkship panel, to enhance diversity on the bench. PRESS RELEASE: AABANY APPLAUDS DIANE GUJARATI’S RENOMINATION TO SERVE AS U.S. DISTRICT JUDGE IN THE EASTERN DISTRICT OF NEW YORK

NEW YORK – April 16, 2019 – The Asian American Bar Association of New York (“AABANY”) enthusiastically supports the renomination of Board Member Diane Gujarati to serve as a United States district court judge in the Eastern District of New York. “We are pleased with the renomination of our former Board Director Diane Gujarati to the bench,” said Brian Song, President of AABANY. Ms. Gujarati was first nominated by President Obama in 2016, and subsequently renominated by President Trump in 2018. Her nomination was unanimously approved by the Senate Judiciary Committee.

“Diane is actively involved with AABANY on various levels and served with distinction as a dedicated member of our Board. Her intelligence, work ethic, judgment and dedication to serving the community will make her an exceptional federal judge,” continued Mr. Song

Asian Pacific Americans (“APAs”) are significantly under-represented in the Federal Judiciary, including in New York State. If confirmed, Ms. Gujarati will be the first Article III judge of South Asian descent in the Second Circuit. “We welcome the announcement of Diane’s renomination,” said Dai Wai Chin Feman, Co-Chair of AABANY’s Judiciary Committee. “She is a trailblazer in the community and will be an excellent addition to the federal judiciary. Diane has already been approved by the Senate Judiciary Committee, and we look forward to her taking the bench in the Eastern District.”

Ms. Gujarati began her legal career by serving as a law clerk to the Honorable John M. Walker, Jr. of the United States Court of Appeals for the Second Circuit. She then worked as a litigator at Davis Polk & Wardwell before beginning a dedicated, lengthy career in public service. In 1999, Ms. Gujarati joined the United States Attorney’s Office for the Southern District of New York as an Assistant United States Attorney in the Office’s Criminal Division. Since April 2012, Ms. Gujarati has served as Deputy Chief of the Criminal Division. She previously served as Deputy Chief and then Chief of the White Plains Division and as Deputy Chief of the Appeals Unit in the Criminal Division. In addition to her work as a federal prosecutor, Ms. Gujarati taught as an Adjunct Professor of Clinical Law at New York University School of Law. In September 2016, Gujarati was nominated by President Obama to serve as a judge in the U.S. District Court for the Eastern District of New York, with the support of Senators Charles Schumer and Kirsten Gillibrand. Ms. Gujarati also served as an AABANY board member and has been an active member of several AABANY committees, including as a Board Liaison to AABANY’s Prosecutors’ Committee. Ms. Gujarati graduated summa cum laude from Barnard College of Columbia University and received her J.D. from Yale Law School.

AABANY WELCOMES AND APPLAUDS THE CONFIRMATION OF PAMELA K. CHEN TO THE EASTERN DISTRICT OF NEW YORK

NEW YORK – March 5, 2013 – The Asian American Bar Association of New York (“AABANY”) welcomes and applauds the confirmation of Pamela K. Chen to serve as a federal district court judge in the Eastern District of New York. On March 4, 2013, the United States Senate confirmed Pamela Chen by a voice vote to the United States District Court for the Eastern District of New York. “AABANY is delighted to learn that Pamela Chen has been confirmed to serve on the Eastern District of New York bench,” said Mike Huang, President of AABANY. “Ms. Chen is the first Chinese-American female Article III judge outside of California and the second-ever Chinese-American female federal judge in U.S. history, continuing to add to the rich legacy of the Second Circuit and New York State. AABANY applauds President Obama and Senator Schumer for their continued commitment to diversifying the Federal Judiciary.”

Asian Pacific Americans (“APA”) are significantly under-represented in the Federal Judiciary, including in New York State. In fact, according to the 2010 Census, approximately 8.3% of the population of New York State and 14.0% of the population of New York City consists of Asian Americans, and the APA percentage continues to grow at a rate that outpaces all other ethnic groups in the State. In the Eastern District of New York, Ms. Chen joins Judge Kiyo A. Matsumoto as the two Article III judges of APA descent in a district that serves the growing APA communities of Flushing, Queens and Sunset Park, Brooklyn.

“With her confirmation, Ms. Chen joins the growing number of Asian Americans who have been recognized for distinguished service on the federal courts,” said Theodore K. Cheng, Co-chair of AABANY’s Judiciary Committee. “Although Asian Americans remain under-represented at all levels in the Federal Judiciary, President Obama and Senators Schumer and Gillibrand ought to be commended for their tireless dedication to increasing diversity on the federal bench.”

After spending the first five years of her career in the private sector, Ms. Chen began a dedicated and much longer career in public service, with a distinct focus on civil rights work. Ms. Chen served as a trial attorney in the Civil Rights Division of the U.S. Department of Justice. She then moved to New York City in 1998 and became an Assistant United States Attorney in the Criminal Division of the U.S. Attorney’s Office for the Eastern District of New York (“USAO EDNY”). There, she was promoted to Chief of Civil Rights Litigation, Deputy Chief of the Public Integrity Section, and then finally to Chief of the Civil Rights Section. Ms. Chen held that last position since July 2006 except for a brief period of time in 2008 when she accepted an opportunity to serve as the Deputy Commissioner for Enforcement in the New York State Division of Human Rights. She soon returned to the USAO EDNY and has remained there ever since.

AABANY thanks President Obama for nominating Ms. Chen and Senator Charles E. Schumer for recommending her to the President.

On January 31, AABANY’s Judiciary Committee co-organized a community celebration in New York’s Chinatown in honor of the Hon. Randall T. Eng to recognize his historic elevation to Presiding Justice, Appellate Division, Second Department, the first Asian American to be appointed to this position. About 250 attendees filled Delight 28 located at 28 Pell Street in Manhattan’s Chinatown, next door to the building that Presiding Justice Eng and his family first moved into upon arriving in the United States from Hong Kong.

Many AABANY members were present, including President Jean Lee, Immediate Past President Linda Lin and past presidents James Chou, Vincent Chang, Yang Chen and Glenn Lau-Kee. The Prosecutors’ Committee also turned out in force, having honored Presiding Justice Eng as a trailblazer in 2011. Rosemary Yu, ADA from the New York County DA’s office, was one of the organizers of the event, together with Mark Fang, who came to know Justice Eng through the JAG Corp.

Presiding Justice Eng’s parents, wife, sister and in-laws also came out to celebrate along with many community members and leaders, not just in Chinatown but from Westchester as well.

We thank everyone who attended for making this a truly memorable and special occasion.

Press Release: AABANY Celebrates the Appointment of the Hon. Justice Randall T. Eng

The Asian American Bar Association of New York (AABANY) and the AABANY Judiciary Committee celebrate the historic appointment of the Honorable Justice Randall T. Eng as Presiding Justice of the New York Supreme Court Appellate Division, Second Department with a celebratory community dinner.

Justice Eng will be the guest of honor at a celebratory dinner to be held Thursday, January 31, 2013. The dinner will bring together Asian American organizations from all over New York, including Chinatown-based civic groups, Asian Americans in law enforcement, lawyers, judges, law students, and friends. The dinner will be held at 6:30P.M. at Delight 28 Restaurant, 28 Pell Street New York, New York 10013.

Justice Eng is the first Asian American to serve as a Presiding Justice in New York State’s history. With this appointment, Justice Eng adds to his long list of notable ‘firsts,’ such as being the first Asian Pacific American Assistant District Attorney in the State of New York, for which the AABANY Prosecutors’ Committee honored him at its third anniversary reception in 2011.

“Justice Eng has demonstrated strong leadership and exceptional jurisprudential skill at every level in our court system and will do so as Presiding Justice. Moreover, as an Asian American trailblazer, Justice Eng is an inspiration to the Asian American bar and the Asian American community at large,” said Vincent Chang, Co-Chair of AABANY’s Judiciary Committee.
