Criminal Justice Act (CJA) Panel Applications Now Open for US Court of Appeals, 2d Cir.

The Criminal Justice Act Committee of the United States Court of Appeals for the Second Circuit is accepting applications for service on the Court’s Criminal Justice Act Panel. CJA Panel Members represent indigent criminal defendants and petitioners for habeas corpus.


Admission to practice before this Court is a necessary qualification for membership on the Panel. The Court seeks attorneys of superior experience and proven competence in federal appellate criminal defense work. The qualifications of attorneys applying for service on the Panel will be examined by the CJA Committee’s Attorney Advisory Group, which will make recommendations for membership on the Panel. Membership on the Panel will be for a term of one to three years, at the discretion of the Court. Attorneys currently serving on the panel need not reapply until the expiration of their present term.


Application forms for membership on the Criminal Justice Act Panel are available at the Court’s website, or by calling 212-857-8702.


A signed original application, one copy of each of your appellate briefs, and three paper copies of the completed application and your resumé, along with a CD containing both your completed applications and resumé, must be received by the Clerk of Court by 5:00 p.m. on Monday, April 3, 2023.

The Criminal Justice Act/Pro Bono Committee is accepting applications for the Second Circuit’s Pro Bono Panel. The deadline to be considered for appointment in 2021 is July 30, 2021. The Court will continue to accept applications year-round, but applications received after July 30, 2021, will not be considered for appointment until 2022.

Pro Bono Panel members will, at the Court’s invitation or on a litigant’s motion for appointment of counsel, represent pro se litigants in civil appeals that present issues of first impression, complex issues of law or fact, or potentially meritorious claims warranting further briefing and oral argument. Pro bono representation will be provided to litigants who would otherwise be unable to pay for counsel and are ineligible for the appointment of counsel pursuant to the Criminal Justice Act.

Cases in which pro bono counsel will be appointed cover a broad range of legal issues, including prisoner civil rights, labor and employment, discrimination, social security, immigration, and tax law.

Applicants must be admitted to and members in good standing of the Bar of the Second Circuit or have an admission application pending before this Court, and have at least three years of appellate litigation experience. Pro Bono Panel members will serve for a three-year term.

Pro Bono Panel members who were appointed by the Court in 2018 for a three-year term must submit a new application if they wish to remain on the Panel.

An application package containing a resume, a written application (available on the Court’s website at http://www.ca2.uscourts.gov) and three writing samples, preferably appellate briefs on which the applicant was the primary author, must be submitted via email to [email protected] by July 30, 2021 for consideration in 2021.

New CJA Panel Applications Being Accepted

The Criminal Justice Act Committee of the United States District Court for the Eastern District of New York is soliciting applications from highly qualified and experienced criminal defense attorneys for membership on the CJA Panel for the District.

Applications will be accepted from attorneys who are available for case assignments in either the Brooklyn or Central Islip Courthouses, or both. The Committee is also seeking applications from practitioners whose experience is uniquely suited to handling petitions for post-conviction relief.

Assignments to the Panel will be for a three-year period, beginning January 1, 2020.

Applications are available at the Clerk’s Offices at the Courthouses in Brooklyn and Central Islip. The form of the application has also been posted at the Court’s website at:

CRIMINAL JUSTICE ACT APPLICATIONS

The Criminal Justice Act Committee of the United States District Court for the Eastern District of New York is soliciting applications from experienced criminal defense attorneys for membership on the CJA Panel for the District. Applications are being accepted now for a three year period beginning January 1, 2018.

New CJA Mentoring Program in the EDNY

The Criminal Justice Act (“CJA”) Committee of the Eastern District of New York is implementing a new Mentoring Program for criminal practitioners who are interested in gaining federal criminal experience and participating in the CJA Panel.  Although one objective of the Mentoring Program is to encourage increased diversity among our Panel members, all interested, qualified candidates are encouraged to apply.  

Please circulate the Program description and Mentee application to any members of your organization who may be interested in applying.  Applications are available on the EDNY webpage and must be submitted to the Clerk of Court on or before November 23, 2016.

SOUTHERN DISTRICT OF NEW YORK SEEKING CANDIDATES FOR CRIMINAL JUSTICE ACT MENTORING PROGRAM

The United States District Court for the Southern District of New York is seeking candidates for its Criminal Justice Act (CJA) Mentoring Program. Ideal candidates are attorneys with five or more years of experience litigating in state court, with fifteen felony trials to verdict as lead counsel or comparable in-court experience under their belt. Under the supervision of a member of the CJA Panel, CJA Mentees would represent defendants in federal court who qualify for appointed representation under the Criminal Justice Act.

The purpose of the CJA Mentoring Program is to diversify the composition of the CJA Panel—a roster of private attorneys who are authorized to serve as appointed defense counsel pursuant to 18 U.S.C. § 3006A—and to expose experienced state court practitioners to federal practice. While the mentee’s initial 15 hours of service will be done pro bono, mentees may earn a reduced rate of $65 per hour for their services after the pro bono requirement has been fulfilled.

SOUTHERN DISTRICT OF NEW YORK SEEKING CANDIDATES FOR CRIMINAL JUSTICE ACT PANEL

The United States District Court for the Southern District of New York is seeking applicants for the SDNY Criminal Justice Act (CJA) Panel.  Applications are available on the court’s website at www.nysd.uscourts.gov/cja.php. Completed applications must be addressed to David Patton, Executive Director of the Federal Defenders of New York, and submitted electronically by May 31, 2014 to [email protected]; no paper applications will be accepted.

The CJA Panel is comprised of private attorneys who are authorized to serve as appointed defense counsel pursuant to 18 U.S.C. § 3006A. To qualify for a position on the CJA Panel, attorneys must be members in good standing of the Southern District and have proven experience and competency in the field of federal criminal defense work. Applications will be reviewed by a committee of attorneys that will forward its recommendations to the Southern District Board of Judges’ Defender Services Committee. The Court is committed to increasing the diversity of the applicant pool and encourages qualified female and minority lawyers to apply for positions.

Candidates can apply to be a member of either the Foley Square or the White Plains CJA Panels, or to both panels. CJA Panel attorneys commit to being “on duty” one day every four to six months if a member of the Foley Square panel and approximately one day every month if on the White Plains panel. On that “duty day,” CJA attorneys represent clients when the Federal Defender has a conflict; the hours of duty are from 9:00 a.m. until the closing of the Magistrate Judges Office, which is sometimes after 5:00 p.m. CJA Panel members serve a three-year term and are reimbursed at the rate of $126/hour for in-court and out-of-court time.

“Our justice system owes a great debt to the efforts of CJA attorneys,” said United States District Judge Cathy Seibel, who leads the Southern District’s Defender Services Committee. “They are instrumental to fulfilling the Constitutional mandate that every defendant has a right to
counsel.”

Southern District Chief Judge Loretta A. Preska said, “The Southern District’s CJA Panel is the best in the nation, and we are fortunate that so many capable attorneys take part in this program.”

Attorneys can also apply for membership on panels that represent defendants in capital cases and in non-trial work, primarily habeas corpus proceedings. In addition, the Southern District also sponsors a mentoring program that helps identify and prepare experienced state court
practitioners for appointment to the Panel. While the mentorship program is aimed at increasing the diversity of the Panel, the program is open to all.
