Thank You to the Volunteers at the March Pro Bono Clinic in Brooklyn

On March 9, 2024, the AABANY Pro Bono & Community Service (PBCS) Committee held its Brooklyn Pro Bono Clinic at the Chinese-American Planning Council (CPC) Brooklyn Community Services Center, the first Brooklyn clinic of the year. Beginning at 12:30, attorneys, interpreters, and other volunteers met with community members who presented legal issues pertaining to immigration, criminal, divorce, and housing law. 

Thanks to the efforts of volunteer interpreters, the majority of whom were law students and recent JD graduates, the Pro Bono Clinic was able to meet with Spanish and Mandarin-speaking clients with limited English proficiency. This unique aspect of the clinic allowed our volunteers to overcome language barriers, enabling clients to express and understand their matters with greater ease. They also had the assistance of a volunteer attorney with criminal law experience providing legal advice on the two criminal cases presented. One client traveled from Warwick, NY to seek legal advice. Clients whose matters required the retention of an attorney were referred to AABANY’s Legal Referral and Information Service (LRIS), which connects clients to qualified lawyers within AABANY’s panel of attorneys. 

The PBSC Committee would like to thank the CPC, Councilmember Alexa Avilés, State Senator Senator Iwen Chu, Councilmember Justin Brannan, and all of their Brooklyn community partners and volunteers for joining them at the Brooklyn Pro Bono Legal Clinic.

United States District Court Eastern District of New York Announces One Full-Time Federal Magistrate Judge Vacancy

FOR IMMEDIATE RELEASE

Chief Judge Margo K. Brodie announced today that the Judges of the United States District Court for the Eastern District of New York have appointed a Merit Selection Panel composed of attorneys and residents of the district (see Administrative Order No. 2023-12 on the Court’s website). The Panel will consider candidates for an anticipated United States Magistrate Judge vacancy in Brooklyn, New York, for an eight (8)-year term. The vacancy will be created by the anticipated elevation of U.S. Magistrate Judge Ramon E. Reyes to United States District Judge.

All applications for the magistrate judge vacancy must be received by May 5, 2023. The application form can be accessed online at the district’s website. Application forms also may be obtained from the Clerk of Court in the Public Announcements. Please see the public notices below for instructions on how to submit applications for the magistrate judge vacancy.

Within ninety (90) days from its appointment on April 4, 2023, the Panel must report to the Court its recommended slate of candidates for consideration for the Magistrate Judge vacancy.

PUBLIC NOTICE

ONE FULL-TIME FEDERAL MAGISTRATE JUDGE VACANCY

There is one (1) anticipated full-time United States Magistrate Judge vacancy at the Brooklyn Courthouse of the Eastern District of New York at 225 Cadman Plaza, Brooklyn, New York. The duties of the position are demanding and wide-ranging, and will include: (1) conduct of preliminary proceedings in criminal cases; (2) trial and disposition of misdemeanor cases; (3) conduct of various pretrial matters and evidentiary proceedings on delegation from the judges of the district court; (4) trial and disposition of civil cases upon consent of the litigants; and (5) assignment of additional duties not inconsistent with the Constitution and laws of the United States.

The jurisdiction of a United States Magistrate Judge is specified in 28 U.S.C. § 636. To be qualified for appointment, an applicant must: (a) be a member in good standing of the bar of the highest court of a state, the District of Columbia, the Commonwealth of Puerto Rico, or the U.S. Virgin Islands for at least five years; (b) have been engaged in the active practice of law for a period of at least five years (with some substitutions authorized); (c) be competent to perform all the duties of the office, of good moral character, emotionally stable and mature, committed to equal justice under the law, in good health, patient and courteous, and capable of deliberation and decisiveness; (d) be less than 70 years old; and (e) not be related to a judge of the district court. An applicant should have federal court experience and be knowledgeable in federal civil and criminal practices and procedures.

A Merit Selection Panel (appointed by Administrative Order 2023-12) composed of attorneys and residents of the district will review all applications and recommend in confidence to the judges of the district court the five persons whom it considers best qualified for the vacancy. The Court will make the appointment following FBI and IRS investigations of the appointee. An affirmative effort will be made to give due consideration to all qualified candidates, including women and members of minority groups. The salary of the position is, as of this notice, $213,992 per annum. The term of office is eight years.

Criminal Justice Act (CJA) Panel Applications Now Open for US Court of Appeals, 2d Cir.

The Criminal Justice Act Committee of the United States Court of Appeals for the Second Circuit is accepting applications for service on the Court’s Criminal Justice Act Panel. CJA Panel Members represent indigent criminal defendants and petitioners for habeas corpus.


Admission to practice before this Court is a necessary qualification for membership on the Panel. The Court seeks attorneys of superior experience and proven competence in federal appellate criminal defense work. The qualifications of attorneys applying for service on the Panel will be examined by the CJA Committee’s Attorney Advisory Group, which will make recommendations for membership on the Panel. Membership on the Panel will be for a term of one to three years, at the discretion of the Court. Attorneys currently serving on the panel need not reapply until the expiration of their present term.


Application forms for membership on the Criminal Justice Act Panel are available at the Court’s website, or by calling 212-857-8702.


A signed original application, one copy of each of your appellate briefs, and three paper copies of the completed application and your resumé, along with a CD containing both your completed applications and resumé, must be received by the Clerk of Court by 5:00 p.m. on Monday, April 3, 2023.

Justices D’Emic, Chun appointed to administrative posts in Brooklyn | Brooklyn Daily Eagle

Chief Administrative Judge A. Gail Prudenti has announced the appointments of Hon. Matthew D’Emic as administrative judge for criminal matters in state Supreme Court, Kings County, and Hon. Danny Chun as Kings County’s deputy administrative judge for Criminal Matters.

AABANY congratulates Hon. Danny Chun on his appointment by Chief Administrative Judge Gail Prudenti to the position of Deputy Administrative Judge for Criminal Matters in Kings County. The appointment was approved by Chief Judge Jonathan Lippman and was made in consultation with Presiding Justice Randall Eng of the Second Department.

From the article:

Justice Chun’s judicial career began in 1999, upon his appointment to New York City Criminal Court, Kings County. He was designated an acting Supreme Court justice in 2004 and was temporarily assigned to the Kings County Family Court bench. In 2009, he was reappointed to New York City Criminal Court.

Judge Chun previously served as an assistant district attorney in Manhattan, where over his 12-year tenure he took on a variety of assignments, including the role of Criminal Court supervisor, with oversight for the office’s junior prosecutors. Judge Chun lectures on the subject of criminal law and taught classes in U.S. criminal procedure and trial advocacy as an adjunct professor at Yonsei University School of Law in Seoul, South Korea. He earned his undergraduate degree from Johns Hopkins University and his Juris Doctor from Fordham University School of Law.

SDNY ORDERS: Extensions of deadlines in civil, criminal cases

Chief Judge Loretta A. Preska of the United States District Court for the
Southern District of New York issued three orders today regarding the
extension of deadlines in civil and criminal cases as a result of Hurricane
Sandy. I previously sent the order related to Federal Rule of Criminal
Procedure 45, which is attached here again. The two other orders related to
civil cases and Fed. R. Crim. P. 32 were issued later. All three orders are
also available on the home page of our website at http://nysd.uscourts.gov.

Pursuant to the Judicial Conference of the United States Policy on Privacy and Public Access to Electronic Case Files, as of September 1, 2012, official transcripts of criminal court proceedings taken by official court reporters, contract court reporters, and transcribers will be made available electronically on the Court’s Electronic Case Filing (ECF) system and through the Public Access to Court Electronic Records (PACER) system. This policy will apply to all official transcripts of criminal proceedings or parts of criminal proceedings ordered on or after the above date.
