NAPABA 2023-24 Elections: Deadline for Nominations Extended to July 7

The Nominations and Elections Subcommittee has extended the period for accepting nominations for Officer and Director candidates and applications for At-Large Board Member candidates for the 2023-24 NAPABA Board of Governors. Submissions will now be accepted until July 7, 2023 at 8:00 pm ET.

As the nation’s largest Asian Pacific American membership organization, NAPABA continues to grow exponentially—maturity, stature, and staff. The NAPABA Board of Governors cultivates the strategic direction of the organization, provides resources to achieve goals and strategy, and exercises oversight ensuring the advancement of NAPABA’s strategic plan. The governing Board of 23 and national staff of eight complement and collaborate with each other—together united with a shared focus on advancing NAPABA’s mission through different perspectives and actions.

NAPABA is committed to having a governing board that reflects the diverse Asian American Native Hawaiian Pacific Islander (AANHPI) legal community and has the right blend of skill, expertise, community connections, and diverse perspectives. We value an inclusive culture that embraces our diversity and empowers leaders to engage with each other and the community in a meaningful way by building trust, increasing transparency, and maximizing impact. We seek outstanding individuals of high character and integrity with proven leadership and board governance skills and who have demonstrated a strong commitment to NAPABA. Positions subject to election include President-Elect, Secretary, Treasurer, and Director (one position open). There are three available positions for At-Large Board Members subject to appointment.

NAPABA Applauds the Nomination of Lisa Wang to the U.S. Court of International Trade

WASHINGTON – June 28, President Joe Biden announced his intent to nominate Lisa Wang to serve on the United States Court of International Trade. She would be the second individual from the AANHPI community to serve on this Article III court if confirmed.

“NAPABA congratulates Lisa Wang on her nomination,” said Sandra Leung, President of NAPABA. “A dedicated public servant, Assistant Secretary Wang immigrated to the United States when she was five years old and built a successful career in international trade. We applaud President Biden for nominating her to the court and urge the Senate to confirm her swiftly.”

Lisa Wang is the Assistant Secretary of Commerce for Enforcement and Compliance. She is the U.S. Department of Commerce’s delegate on the Interagency Working Group for the White House Initiative on Asian Americans, Native Hawaiians, and Pacific Islanders. In this role, Assistant Secretary Wang supports the Administration’s whole-of-government agenda to advance equity, justice, and opportunity for AANHPI communities.

Before her appointment, she was a partner at Picard Kentz & Rowe LLP where she focused on international trade law matters, including antidumping, countervailing duty litigation, and trade policy issues. Assistant Secretary Wang also served as Senior Attorney with the Office of the Chief Counsel for Trade Enforcement and Compliance at the Department of Commerce, as Assistant General Counsel in the Office of the U.S. Trade Representative, and as Senior Import Administration Officer at the U.S. Embassy in Beijing, where she was awarded Commerce’s Bronze Medal Award for Distinguished Performance. She received her J.D. from Georgetown University Law Center in 2006 and her B.S. from Cornell University

NAPABA Statement on the U.S. Supreme Court’s Affirmative Action Decision

WASHINGTON – The National Asian Pacific American Bar Association (“NAPABA”) is disappointed in the United States Supreme Court’s decision today in Students for Fair Admissions v. Harvard and Students for Fair Admissions v. University of North Carolina, which held that the consideration of race, as one factor among many in a holistic college admissions process, violates the Equal Protection Clause of the Fourteenth Amendment. With colleges and universities acting as incubators for the future leaders of the Nation, the decision now places an obstacle to achieving diversity, equity, and inclusion in the pipelines of leadership.

As detailed in A Portrait of Asian Americans in the Law 2.0: Identity and Action in Challenging Times (Portrait Project 2.0) published by the American Bar Foundation and NAPABA, we know that though the Asian American, Native Hawaiian, and Pacific Islander community has seen progress in some areas, underrepresentation of our community in the top ranks of the legal profession persists. Portrait Project 2.0, along with NAPABA’s amicus brief with the Court, highlighted the continuing need to advance diversity efforts in the legal profession, where the AANHPI community, along with all communities of color, struggle to achieve success.

At bottom, the Court’s decision today places an impediment to efforts to diversify the legal pipeline at its early stages, the college admissions process. Despite the ruling, NAPABA remains committed to its long-standing values. Whether advancing our leadership and mentorship programs, working with the private sector, government, and public interest stakeholders, or through our partnership with the law student community, NAPABA remains acutely focused to ensure that the profession and leadership reflect the communities that they serve and that the AANHPI community is meaningfully represented.

NAPABA and APABA Tampa Bay Oppose Florida Alien Land Law in Court

WASHINGTON – The National Asian Pacific American Bar Association (NAPABA) and the Asian Pacific American Bar Association of Tampa Bay (APABA Tampa Bay) joined the Fred T. Korematsu Center for Law and Equality, the Hispanic National Bar Association, the South Asian Bar Association of North America, and other partners to oppose the Florida Conveyances to Foreign Entities Law (“SB 264”), a new statute that would prohibit individuals from purchasing real property in Florida based on national origin. The coalition filed an amicus brief, which can be found here, with the United States District Court for the Northern District of Florida in support of the plaintiffs’ motion for a preliminary injunction in Yifan Shen v. Wilton Simpson. The motion seeks a preliminary injunction barring the enforcement of SB 264.

The amicus brief continues the advocacy efforts of NAPABA and our Florida affiliates in opposing SB 264 during the legislative process. In yesterday’s brief, the coalition argued that laws such as SB 264 are “stains on American history” and that alien land laws have “historically and consistently been struck down as invidiously discriminatory.” They promote discrimination against the Asian American, Native Hawaiian, and Pacific Islander community and endanger these populations under the guise of national security concerns.

The opposition to SB 264 coincides with the leadership of NAPABA and its affiliates in combatting similar efforts across the nation. Beyond Florida, NAPABA has opposed similar legislation introduced in Texas, Louisiana, and Alabama that targeted the AANHPI community. During NAPABA Lobby Day last month, our members demanded that Congress act in response to state actions restricting our communities’ ability to pursue a livelihood. Days later, Rep. Judy Chu of California, who chairs the Congressional Asian Pacific American Caucus, and Rep. Al Green of Texas introduced the Preemption of Real Property Discrimination Act in the United States House of Representatives. The bill, which NAPABA endorsed the same day, would nullify any state law that prohibits or otherwise restricts an individual’s right to purchase real property based only on that individual’s citizenship.

NAPABA President Sandra Leung denounced state efforts to enact such discriminatory policies, which “eerily recall ancient alien land laws, which were enacted over a hundred years ago, that barred Asian immigrants from owning land. Such laws belong in the dustbin of history, and they have no place in our nation today. While policymakers are free to address the legitimate national security concerns of the United States, they may not enact discriminatory laws on the backs of the Asian American, Native Hawaiian, and Pacific Islander community.”

“Unless enjoined, SB 264 will be applied in discriminatory ways and inflict lasting damage on Asian Pacific American communities in Florida and beyond,” said SeungEun April Lee, President of APABA Tampa Bay.

AABANY Members Visit Capitol Hill for NAPABA Lobby Day

On May 22 and 23, 2023, AABANY members Yen-Yi Anderson, Vishal Chander, Chris Kwok, Rachel Lee, and Nandar Win Kerr converged on Washington D.C. for National Asian Pacific American Bar Association (NAPABA) Lobby Day. Each year, NAPABA organizes the event to educate members of Congress on issues of importance to the Asian American, Native Hawaiian, and Pacific Islander (AANHPI) community. NAPABA Lobby Day is scheduled to coincide with AANHPI Heritage Month in May of each year.

AABANY members met with the legislative staff of House Minority Leader Hakeem Jefferies, Congressman Jerrold Nadler, and Senator Kirsten Gillibrand. They discussed issues such as support for the LGBTQ+ community, protection of the right to counsel in immigration, mental health support for AANHPI and other diverse communities, profiling persons of Chinese ancestry, state passage of alien land laws, and AANHPI judicial and executive nominees.

Rachel Lee, an associate at Allen & Overy LLP, shared, “I am happy to have participated in NAPABA Lobby Day this year. It was an educational and eye-opening experience to learn about different issues impacting the AANHPI community and be able to advocate for our community on Capitol Hill at various congressional offices with fellow NAPABA members. I highly recommend the program and would participate again in the future.”

NAPABA Endorses the Preemption of Real Property Discrimination Act

WASHINGTON – In response to the troubling rise in state legislative activity attacking an individual’s right to purchase real property based on the purchaser’s citizenship, the National Asian Pacific American Bar Association (NAPABA) endorses the Preemption of Real Property Discrimination Act. Introduced today in the United States House of Representatives by Rep. Judy Chu of California, who chairs the Congressional Asian Pacific American Caucus, and Rep. Al Green of Texas, the bill would nullify any state law that prohibits or otherwise restricts an individual’s right to purchase real property based merely on that individual’s citizenship.

“NAPABA will not stand idly by when our community, especially those who trace their ancestry to China, becomes the target of ill-advised efforts by state policymakers to strip them of their fundamental rights to pursue a livelihood,” said Sandra Leung, the President of NAPABA.

“These efforts eerily recall ancient alien land laws, which were enacted over a hundred years ago, that barred Asian immigrants from owning land. Such laws belong in the dustbin of history, and they have no place in our nation today. While policymakers are free to address the legitimate national security concerns of the United States, they may not enact discriminatory laws on the backs of the Asian American, Native Hawaiian, and Pacific Islander community.”

NAPABA’s support today for the Preemption of Real Property Discrimination Act coincides with the leadership of NAPABA affiliates across the nation to combat state legislation targeting our community. This past week, the Louisiana Asian Pacific American Bar Association (LAPABA), with NAPABA’s support, opposed legislation that, if enacted, would have barred innocent parties from purchasing or leasing real estate. Similarly, the Alabama Asian Bar Association (AABA), also with NAPABA’s support, led the opposition to a bill in Alabama that would prevent “any individual who is a citizen of China” from purchasing any real estate.

The actions of LAPABA and AABA build on NAPABA’s collaboration with our Florida affiliates – the Asian Pacific American Bar Association of Tampa Bay (APABA-TB), the Asian Pacific American Bar Association of South Florida (APABA-SF), the Greater Orlando Asian American Bar Association (GOAABA), and Jacksonville Asian American Bar Association (JAABA) – and our Texas affiliates – the Asian American Bar Association of Houston (AABA Houston), the Austin Asian American Bar Association (Austin AABA), and the Dallas Asian American Bar Association (DAABA) – in combatting similar efforts in Florida and Texas. NAPABA is grateful for their leadership.

2023 NAPABA Lobby Day Wrap-Up

Reflecting on a Day of Advocacy and Engagement

NAPABA’s 12th annual Lobby Day, held on May 22-23, 2023, brought together a diverse group of AANHPI attorneys, law students, and community leaders from across the country to advocate for meaningful policy changes and address key issues affecting our community. Together, we engaged in productive discussions, shared compelling stories, and sought to create lasting connections with lawmakers and their staff. 

Highlights of our Lobby Day achievements include:

Robust Representation: With nearly 90 participants taking part in 52 meetings with congressional offices, NAPABA demonstrated its strength and its commitment to amplifying AANHPI voices in the halls of power.

Advocacy Training: Prior to the meetings, we organized targeted training sessions to equip our participants with the necessary tools and strategies to effectively communicate our policy priorities. 

Policy Priorities: Throughout our meetings, we passionately advocated for key issues at the forefront of our community’s concerns, which included the fair treatment of immigrants, the equal rights of the LGBTQ+ community, and the ability of the AANHPI community to pursue their livelihood. Our collective advocacy efforts ensured that these critical topics received the attention they deserve.

Meaningful Engagements: We met with several influential lawmakers and their staff, fostering meaningful dialogues and building relationships that will continue to be instrumental in advancing our policy objectives. Our Lobby Day participants skillfully articulated our positions, presented compelling arguments, and shared personal stories to humanize the issues we face.
