NAPABA Hosts Part 2 of its Summer Judicial Series, “APA Judges on the Federal Bench”

On May 7, AABANY co-sponsored a panel of Asian Pacific American judges as part two of NAPABA’s Summer Judicial Series. The event was hosted by the Georgia Asian Pacific American Bar Association (GAPABA) and the National Asian Pacific American Bar Association (NAPABA). In addition to AABANY, the event was co-sponsored by the Asian Pacific American Bar Association of the Greater Washington, D.C. Area (APABA-DC), the Asian Pacific American Bar Association Educational Fund (AEF), the National Asian Pacific American Law Student Association (NAPALSA), the South Asian Bar Association of North America (SABA), and the South Asian Bar Association of Georgia (SABA-GA).

In honor of Asian Pacific Islander Heritage Month as well as to encourage the growing number of young Asian American lawyers aspiring to the bench, GAPABA and NAPABA organized the panel to share the stories and careers of trailblazing APA judges. The panelists were AABANY member Hon. Denny Chin, of the U.S. Court of Appeals for the Second Circuit, Hon. James C. Ho of the U.S. Court of Appeals for the Fifth Circuit, Hon. Sri Srinivasan, Chief Judge of the U.S. Court of Appeals District of Columbia Circuit, Hon. Jennifer Choe-Groves of the U.S. Court of International Trade, Hon. Theodore D. Chuang, of the U.S. District Court for the District of Maryland, and Hon. Lucy H. Koh, of the U.S. District Court for the Northern District of California.

The panel was moderated by GAPABA Board Member Michael C. Wu and Byung Jin (BJay) Pak, Partner at Alston & Bird. GAPABA President and Of Counsel at Bryan Cave Leighton Paisner Angela Hsu, GAPABA President-Elect and Associate General Counsel at Delta Air Lines Timothy Wang, and GAPABA Communications Co-Chair and Law Clerk for the U.S. District Court for the Western District of Texas Prathyusha Chenji were also in attendance.

Michael and BJay posed several questions to the panelists regarding their backgrounds and experience on the bench. All of the panelists expressed how their upbringing in the U.S. made them keenly aware of their “otherness” and in some cases, motivated them towards public service. Judge Chin (a former AABANY President, 1992-93) shared his background as an immigrant from Hong Kong and his experience growing up in New York City. Judge Chin also noted that, as one of the few Asians in his school and at his work, he was constantly under scrutiny and pressure to perform well. “I felt like Yao Ming,” he stated. Several panelists also reported that they still faced microaggressions in their professional lives, despite their position as judges.

When asked about their career paths and perspectives on diversity on the bench, all of the panelists described varied experiences in private practice, the legislative branch, and executive branch of the government before becoming a federal judge. Many of the panelists also expressed how diversity in the federal government could only lead to better and more informed decisions on behalf of the American people. Many of the panelists also shared their own stories about how they were inspired and encouraged by seeing diverse individuals serving in government and in public positions. All of the judges expressed how the justice system in America ought to be color blind and that all individuals should have the right to a fair trial regardless of their background. Judge Chin also discussed the importance of community and unity despite having diverse perspectives. When asked to respond to Supreme Court Justices Neil M. Gorsuch and Sonia Sotomayor’s discussion on the threat of disunity to national security, Judge Chin concurred, pointing out how even after President Biden’s election, Americans have yet to listen to each other without politicizing every single issue.

The moderators then closed the panel with several questions about advice any of the judges might have for young attorneys, law clerks, and others aspiring to become judges themselves. The panelists expressed how being a judge begins with being a good attorney. All of the judges emphasized the importance of relationships and teamwork, of maintaining a good reputation, and of being respectful and professional to all.

NAPABA Congratulates Angel Kelley on her Nomination to serve on the District Court for the District of Massachusetts

WASHINGTON – Today, as part of the third slate of judicial nominees sent to the Senate, President Joe Biden nominated Massachusetts Superior Court Judge Angel Kelley to become a federal district court judge for the District of Massachusetts.  If confirmed, Judge Kelley would become only the second African American woman judge and second Asian American judge to serve on the Massachusetts district court, following Judge Indira Talwani who was confirmed in 2014. 

NAPABA applauds the Biden Administration for continuing to nominate experienced individuals  with diverse professional and personal backgrounds who reflect the diversity of the country. The daughter of a Japanese immigrant mother who found work as a meat packer, and an African American father originally from Selma, Alabama who was a truck driver, Judge Kelley began her legal career as a staff attorney at the Legal Aid Society working in the Juvenile Rights Division in Brooklyn, New York, served as an Assistant U.S. Attorney in U.S. Attorney’s Office for the District of Massachusetts, and began her judicial service on the Massachusetts state court in 2009.

Judge Kelley received her LL.M. in Trial Advocacy from Temple University in 2003, her J.D. from Georgetown University in 1992, and her B.A. from Colgate University in 1989.

NAPABA Partners With Asian & Pacific Islander American Health Forum to Address COVID-19 Through CDC Grant Funding Opportunity

WASHINGTON – NAPABA is proud to announce that the Asian & Pacific Islander American Health Forum (APIAHF) has awarded it grant funding under the Center for Disease Control and Prevention’s (CDC) Engaging AANHPI Communities in Adult Vaccination (EVAC) program. Under this award, the first received in its history, NAPABA will leverage its nationwide network of nearly 90 affiliate organizations and its expertise at the intersection of language access and anti-Asian hate violence to enhance vaccine confidence and uptake of COVID-19 and influenza vaccinations.

“The nearly 4,000 reported incidents of anti-Asian hate, and the countless acts of hate that go unrecorded, has had an impact on our communities to live safely, including getting vaccinated for COVID-19. Community members are scared to leave their homes and are not making appointments for the vaccinations for fear of being targeted,” said Priya Purandare, Executive Director of NAPABA. “In this environment, we especially want to ensure that the most vulnerable AANHPI persons are able to receive the vaccine: the elderly, those with limited English proficiency, recent arrivals, undocumented persons, those on the unconnected side of the digital divide, and others who lack access to COVID-19 information and vaccinations. We are honored to collaborate with APIAHF and over 20 partners nationwide to ensure vaccine confidence, access, and equity.”

In recognition that vaccine messaging will be conducted in the same communities experiencing increased threats and attacks based on the falsehood that AANHPIs are responsible for the pandemic, NAPABA and APIAHF have developed a ground-breaking collection of Combat Hate Crimes Toolkits translated into 25 different AANHPI languages – the largest compilation of its kind. These toolkits provide critical information for victims, community-based organizations, and community leaders on how to report attacks to law enforcement and how to help AANHPI communities deter future threats. NAPABA supports vaccination efforts by deploying these legal and advocacy educational resources in tandem with COVID-19 vaccine information so that AANHPI community members feel safe to leave the house, obtain their vaccines, and return to normalcy without suffering the additional threat of bias motivated attacks.

“NAPABA and its membership has THE largest nationwide boots on the ground reach of any AANHPI organization in the country, including in discrete and hard to reach areas where little infrastructure exists for the community,” said Juliet K. Choi, President and Executive Director of the APIAHF. “This historical and innovative strategic partnership with NAPABA will increase COVID-19 vaccination education by leveraging their members who are trusted civic leaders in their local communities that work to address community needs across a wide spectrum of issues.”

NAPABA plans to mobilize its nationwide network of nearly 90 affiliates and our members’ substantive legal expertise across a range of areas, drawing especially on its innovative work in linguistic access, and will be hiring an Education Coordinator for COVID-19 Vaccination Equity to help fulfill this mission.

NAPABA Statement on the Senate Confirmation of Vanita Gupta

WASHINGTON – The National Asian Pacific American Bar Association (NAPABA) congratulates Vanita Gupta on her historic bipartisan confirmation by the Senate, to serve as Associate Attorney General in the U. S. Department of Justice (DOJ), the third highest ranking position at the Department. She now becomes the most senior Asian American Pacific Islander (AAPI) leader at DOJ ever, and the first woman of color to serve as Associate Attorney General.

“NAPABA is thrilled that the Senate has confirmed Vanita Gupta to lead the DOJ’s efforts in the critical areas of civil rights, the environment, justice-oriented grant making, community policing, community relations, violence against women, tax enforcement, antitrust, and ensuring the rights of service members and veterans, among other responsibilities” said A. Statement On S. 937 COVID-19 Hate Crimes Act

Today, the United States Senate, in an overwhelmingly 94-1 bipartisan vote, passed S. 937, the “COVID-19 Hate Crimes Act” introduced by Senator Mazie Hirono (D-HI).  This legislation requires that the U.S. Department of Justice designate a point person whose sole responsibility is to facilitate the expedited review of hate crimes related to the COVID-19 pandemic. Notably, the legislation recognizes a “COVID-19 hate crime” as an act of violence motivated by the actual or perceived relationship to the spread of COVID-19 of any person based on their race, ethnicity, age, color, religion, national origin, sexual orientation, gender, gender identity, or disability. The Senate-passed legislation also incorporates the Jabara-Heyer No Hate Act which increases resources for hate crimes reporting and assistance for victims of hate crimes.

“NAPABA congratulates the Senate for passing this important legislation, and Senator Hirono for her leadership on this issue,” said NAPABA President A.B. Cruz III. “This bill squarely addresses one of the root causes of the increase in hate crimes and bias-motivated incidents being committed against the Asian American community – the dangerous rhetoric and falsehood that somehow Asian Americans are responsible for the COVID-pandemic. NAPABA is committed to ensuring justice for hate crimes and hate-motivated incidents committed against the Asian American community, and looks forward to swift passage in the House and enactment into the law.”

NAPABA believes this bill will help state and local law enforcement to better investigate and record hate crimes and hate incidents and prosecute them where appropriate. The legislation also requires the Department of Justice to issue guidance on establishing online hate crimes and hate incident reporting in multiple languages, and to work with the Department of Health and Human Services to issue guidance on best practices to mitigate discriminatory language in describing the COVID-19 pandemic.  In response to the surge in attacks against Asian Americans in the wake of the pandemic, NAPABA in partnership with the APIA Health Forum have produced a hate crimes reporting toolkit – translated into 25 languages and English – the single largest collection of different AAPI-language materials assembled, that provides basic and critical information for victims, community based organizations, and community leaders.

MNAPABA and NAPABA Statement on the Verdict in the Trial of Derek Chauvin

Over the past year, in the wake of the tragic deaths of George Floyd, Ahmaud Arbery, and Breonna Taylor, amongst others, MNAPABA and NAPABA expressed their support of and solidarity with the Black community in Minnesota and across the nation.  Today, a jury in Minneapolis has convicted Derek Chauvin on all counts charged in the killing of George Floyd. MNAPABA and NAPABA acknowledge the pain and anguish of the Floyd family and the Black community, and we recognize this is but one chapter in the ongoing endeavor to improve accountability, training, integrity, transparency, and improvement of this country’s criminal justice system as we have called for in NAPABA’s Resolution in Support of the Black Community.

At this critical inflection point in race relations in the United States, and as our own communities face a surge in reported hate crimes and bias-motivated incidents, MNAPABA and NAPABA reiterate their commitment to stand in solidarity with the Black community in Minnesota and across the nation in our shared goal of combating racism, discrimination, hate crimes, and other forms of bigotry. NAPABA recognizes the long history of systemic inequality faced by the Black community in this country and reaffirms its resolution calling for accountability and improving standards of professionalism and conduct in law enforcement. NAPABA has called for building trust between law enforcement and communities of color including by promoting diversity, inclusion, and better training for law enforcement. Community and government leaders must work together to create that trust and fairness in the legal system by combatting bias and safeguarding civil rights, civil liberties, and access to justice for all. While there remains much more work to be done, we hope this outcome helps the country heal and put greater faith in the rule of law.

NAPABA & APIAHF Launch Combat Hate Crimes Toolkit in 24 Languages

In the wake of the coronavirus pandemic, there have been nearly 4,000 recorded hate incidents against the Asian American community, and this number continues to rise. Earlier this week, President Biden announced additional actions to respond to Anti-Asian Violence, Xenophobia and Bias. Attorney General Garland announced a 30-day review to assess the government’s tracking capabilities and prosecution of hate offenses that are surging across the country. The National Asian Pacific American Bar Association (NAPABA) and the Asian & Pacific Islander American Health Forum (APIAHF) are working with the Biden Administration to identify problems and to offer solutions in combating hate crimes.

NAPABA and APIAHF have collaborated to urgently develop a community Combat Hate Crimes Toolkit, which provides basic and critical information for victims, community-based organizations and community leaders. The toolkit, created under the National AA and NHPI Health Response Partnership, is translated into 24 different languages—the single largest collection of AANHPI translated materials ever and includes:

  • Understanding the difference between a hate crime and hate incident
  • Working with law enforcement and the media
  • Checklist for community organizations
  • Frequently asked questions

NAPABA Applauds the Historic Nominations of Judge Zahid N. Quraishi, Judge Florence Y. Pan, and Regina M. Rodriguez to the U.S. District Court

WASHINGTON – Today, President Joe Biden nominated Judge Zahid N. Quraishi to the U.S. District Court for the District of New Jersey, Judge Florence Y. Pan to the U.S. District Court for the District of Columbia, and Regina Rodriguez to the U.S. District Court for the District of Colorado.

If confirmed, Judge Quraishi will be the first AAPI to serve as a federal district court judge in New Jersey and the first American Muslim to serve as an Article III judge in the United States; Judge Pan will be the first AAPI woman to serve as a federal district court judge in the District of Columbia; and Rodriguez would be the first AAPI to serve as an Article III judge in the 10th Circuit.

“NAPABA offers its congratulations to Judge Quraishi, Judge Pan, and Gina Rodriguez on their historic nominations,” said A.B. Cruz III, president of NAPABA. “We applaud President Biden for nominating these well-qualified candidates and taking action to nominate a representative judiciary. These nominations are particularly meaningful to our community, especially in the wake of anti-Asian violence. It is particularly notable that Judge Quraishi would become the first Muslim American Article III judge, and that Judge Pan and Ms. Rodriguez will both have groundbreaking roles if confirmed. We urge the Senate to quickly confirm them.”

Judge Zahid N. Quraishi

In 2019, Judge Quraishi was appointed as a U.S. Magistrate Judge for the U.S. District Court for the District of New Jersey becoming the first AAPI to serve on the federal bench in New Jersey. Prior to his appointment, he was Chair of Riker Danzig’s White Collar Criminal Defense and Investigations Group and his firm’s first Chief Diversity Officer. Previously he served as an Assistant U.S. Attorney for the District of New Jersey and Assistant Chief Counsel and trial attorney with the Department of Homeland Security. A U.S. Army veteran, Quraishi served as a military prosecutor and achieved the rank of Captain in the U.S. Army Judge Advocate General’s Corps. He was awarded a Bronze Star Medal; Army Combat Action Badge; Iraq Campaign Medal; Global War on Terrorism Service & Expeditionary Medals; Army Commendation and Achievement Medals, among other awards for his service. Judge Quraishi is a graduate of John Jay College of Criminal Justice and Rutgers Law School. Judge Quraishi is endorsed by NAPABA’s affiliate APALA-NJ and is the recipient of the Asian Pacific American Lawyers Association of New Jersey Professional Achievement Award in 2019.

Judge Florence Y. Pan

In 2009, Judge Pan was nominated by President Obama to the Superior Court of the District of Columbia and was confirmed by unanimous consent by the Senate. She was the first judicial nominee to be confirmed under the Obama Administration. In 2016, Judge Pan was nominated to the U.S. District Court for the District of Columbia. Previously, she served for 10 years as an assistant U.S. attorney in the U.S. Attorney’s Office for the District of Columbia, including two years as the deputy chief of the appellate division. She also held positions in the Department of the Treasury and the Department of Justice, notably in the Office of the Solicitor General. Judge Pan taught at Georgetown University Law Center and American University, Washington College of Law, and is active in her community having served as the Secretary of NAPABA’s Judicial Council. She formerly served as a law clerk for the Honorable Ralph K. Winter, Jr., of the U.S. Court of Appeals for the Second Circuit and the Honorable Michael B. Mukasey of the U.S. District Court for the Southern District of New York. Judge Pan is a graduate of the University of Pennsylvania and Stanford Law School. Judge Pan is endorsed by NAPABA’s affiliate APABA-DC.

Regina M. Rodriguez

Regina M. Rodriguez is a partner at WilmerHale where she handles complex litigation matters and serves as co-chair of the trial practice group. Previously she worked as a partner at Hogan Lovells US LLP and at Faegre & Benson LLP. Earlier in her career, Rodriguez served as an Assistant U.S. Attorney for the District of Colorado, where she served as the Deputy Chief of the Civil Division and later as Chief of the Civil Division. She received her J.D. from the University of Colorado School of Law and her B.S. with honors from the University of Iowa. Rodriguez is endorsed by NAPABA’s affiliate APABA-CO. She is also active with the Hispanic National Bar Association and serves as a member on its Law Enforcement Reform & Racial Justice Committee.
