General Counsel Roundtable at the 2020 Fall Conference: Promoting Unity and Strength Through Leadership

On Friday, September 25, AABANY kicked off the 2020 Fall Conference, held virtually this year due to COVID-19. The conference theme was “Stronger Together: Unity in Diversity” and commenced with the General Counsel Roundtable program, entitled “Promoting Unity and Strength Through Leadership.” The panelists included:

The program followed a Q&A format and explored a wide range of topics, from the COVID-19 pandemic to Black Lives Matter and anti-Asian violence. Michael Wu started by asking the panelists how the pandemic has impacted their company operations and their outlook as organization leaders. One major takeaway was that legal departments are shifting into more generalist than specialist roles in order to adapt to crisis operations under a “rescue, recover, and reimagine” mandate. All panelists agreed that while companies and communities are currently in the recovery stage, a re-imagined world will look different from before and rely heavily on virtual and digital channels. Amy Weaver succinctly summarized that “two things are the most relevant today” to companies navigating these complex times: first, be a quick study; second, be able to make decisions quickly. 

The panelists were then asked what challenges in diversity and inclusion their companies are facing and how are they being addressed? Rena Reiss emphasized the need to carve out time and space to discuss racial issues that weren’t previously seen as polite workplace conversation. Vanessa Sutherland and Amy Weaver highlighted the snail’s pace at which financial industries and law firms operate with regard to diversity initiatives and stressed the need for immediate change. 

Michael Wu also asked about challenges Asian Americans face in corporate America, whether or not they are seen as minorities, and what advancement initiatives are in place. Panelists acknowledged the racial xenophobia and anti-Asian violence COVID-19 has wrought, and Ann Steines spoke to Black Lives Matter as an opportunity for allyship to advance the meaningful engagement of all diverse individuals in the workplace. 

At the conclusion of the program, Michael asked the panelists to give advice to diverse lawyers seeking career advancement. In response, Vanessa acknowledged the tendency of diverse attorneys to be risk-averse due to the disproportionate pressure placed on them. She encouraged lawyers of color to not be afraid to take risks, because leaders need to demonstrate that they are capable of making uncomfortable decisions.  

Ann recommended that minority lawyers consciously diversify expertise as their career progresses. “As lawyers we’re told to be experts in the areas we practice in. Then you get to a point in your career where you need to expand your horizons,” she stated. “People don’t always put their arm around the diverse candidate to tell them the advice that all the panelists have been giving today.” Ann thus highlighted the lack of formal and informal mentorship that places diverse attorneys at a disadvantage compared to their white counterparts. 

As the panel drew to a close, Michael asked the GCs to share with up-and-coming lawyers the most valuable advice they have received in their career. David Zapolsky offered the following three-part answer: First, to be business people first and lawyers second. Second, “being a lawyer is about preserving your personal credibility even if you have clients who can’t.” Finally, “if you touch it you own it.” 

The GC Roundtable is typically the highlight of the Fall Conference, and this year’s kept in line with prior GC Roundtables, offering impactful and pertinent viewpoints and guidance for all attendees. With this all-star panel the GC Roundtable kicked off another successful Fall Conference and set a high bar for the programs that followed on Saturday.

Congratulations to AABANY Member Naf Kwun for Receiving NAPABA’s 2020 Best Under 40 Award

This December, the 2020 Annual National Asian Pacific American Bar Association (“NAPABA”) Awards Ceremony will be held virtually to honor outstanding attorneys and organizations that have made an impact within the Asian Pacific American community. Among those being honored will be Naf Kwun, a partner at Lee Anav Chung White Kim Ruger & Richter LLP and a valued member of AABANY’s Board of Directors, who has received one of NAPABA’s Best Under 40 awards. Every year, NAPABA recognizes talented individuals within the Asian Pacific American (“APA”) legal community under the age of forty who have achieved prominence and distinction in their fields of endeavor. Recipients are selected on the basis of two factors: first, demonstrated success and professionalism in the practice of law; and second, a commitment to the APA community. A law firm partner, mother to two young kids, and wife, Naf has not only taken an exceptional career path but has also shown a continuous and inspiring dedication to the APA community. 

Naf has achieved the first factor of consideration for this award, a demonstrated success and professionalism in the practice of law, in various ways. After graduating from the University of California at Berkeley,  she founded a small business to support her family before ultimately enrolling at Georgetown University Law Center.  She went on to complete a judicial clerkship with Justice Patricia DiMango of the New York State Supreme Court, Criminal Term, before entering private practice at her current law firm as an associate in the corporate and commercial litigation group. In this small firm setting with clients ranging from Fortune 500 companies to individuals, Naf quickly taught herself civil litigation and corporate law. She overcame the learning curve, impressed the firm’s partners, and by her third year assumed the duties and responsibilities of a senior associate. The firm was especially impressed by Naf’s intelligence, initiative, and management skills, and in 2018, she became the first associate elevated to partnership since the firm’s founding. 

Naf has exemplified the second criterion for the award by demonstrating a commitment to the APA community through her leadership and passion outside of her professional pursuits. Since joining AABANY, Naf has become a dedicated driver of meaningful participation of APAs in the legal profession.  Over the years, she has held nine leadership positions at the committee and board level. Through leadership and collaboration, she has helped carry AABANY’s mission forward, such as by helping to manage over 100 programs as a Vice President of Programs and Operations and working with the Judiciary Committee to increase diversity on the bench. Additionally, as co-chair, Naf led the Women’s Committee to chronicle the progress of APA women attorneys over the last twenty years through a groundbreaking video project called “Kicking Glass from the Courtroom to the Boardroom: Two Decades and Counting”. This project would not only premiere at the 2014 NAPABA Convention but also screened at the 2015 ABA Spring Conference, the 2015 AABANY Fall Conference, and at law firms nationwide. 

Naf’s drive for professional excellence and commitment to the APA community are deeply rooted in her experience as a Korean American immigrant. Growing up in a predominantly white suburb outside of New Orleans, she encountered racism and exclusion, which helped to build her character and developed foundational values of hard work, perseverance, and advocating for others that have brought her to where she is today. 

When asked what advice she has for aspiring lawyers, Naf said her best recommendations are to “be open to opportunities” and “appreciate that when you’re young and starting out, people genuinely want to help you so don’t be afraid to “ask for help.”  She strongly encouraged law students and junior attorneys to join bar associations such as AABANY, and to become active members of the legal community.  In terms of her own aspirations, since becoming a partner she has been more involved in the backend managerial aspect of law practice.  She enjoys learning about the business of running a law firm and hopes to continue to “grow within the firm’s leadership structure.” 

Outside of her career, Naf and her husband stay busy raising their two young boys. Despite their hectic workload, they coordinate across each other’s schedule to make sure they are both present for milestones in their children’s lives.

AABANY Congratulates Libin Zhang on Getting Published in the New York Law Journal

The Asian American Bar Association of New York (AABANY) congratulates Tax Committee Co-Chair Libin Zhang on his recent law review article about the proposed Pied-à-Terre tax impact on Real Estate in the New York Law Journal.

The article begins as follows:

It is no secret that the coronavirus pandemic has reduced New York City’s government revenues: sales taxes are down due to a decline in retail sales, there is less use of public transportation, and some individuals have moved out of the city. But as the late 20th century American proverb goes, in every crisis there is opportunity. A revised “pied-à-terre tax” has been introduced in both chambers of the New York State Legislature, which would create an annual property tax of up to 13.5% on certain residential properties with assessed values of $300,000 or more.

Although the latest pied-à-terre tax proposal is an improvement on prior versions, for example by no longer imposing the tax on most rental properties, some issues and questions remain.  The tax, if enacted, may affect New York City real estate.

AABANY Hosts Weekly Membership Mixer on August 28

On August 28, 2020, the Membership Committee hosted their weekly Zoom Membership Mixer, with 19 participants in attendance. The icebreaker question this week asked participants “What were your favorite moments as a Member of AABANY?” Members mentioned attending Fall Conference, Annual Dinner, and AABANY after parties. 
On Friday we said thank you to our Student Leader volunteers for their work during the pandemic. We were all impressed with these talented law students who found time to give back to New York’s Asian American community with COVID-19 relief assistance and rent relief applications, along with many other activities, led by Will Lee, Vice Chair of the Student Outreach Committee.

Congratulations to Long Dang, one of our illustrious Student Leaders, for winning a $50 VISA gift card!

The Membership Committee previously hosted Monthly Mixers at bars, ballparks, stadiums, operas, etc, but due to COVID, we have moved online to offer members a weekly outlet to share their feelings, see old friends, and make new connections. Mixers start at 6:30pm on Friday and the main event ends at 7:30pm but people have stayed on after 7:30pm for smaller breakout groups.

Membership Committee will continue to host weekly Zoom mixers until it is safe to gather together again in person. 

We are giving away door prizes in some weeks. In order to win, you must be a member and must RSVP on the aabany.org calendar entry to get a raffle number. Non-members can join the Zoom mixer but won’t be eligible to win a prize.

AABANY Presents a Book Talk: Stuck – Why Asian Americans Don’t Reach the Top of the Corporate Ladder

On August 4, 2020, the Asian American Bar Association of New York (AABANY) hosted a book talk on CUNY Professor Margaret Chin’s new book, Stuck – Why Asian Americans Don’t Reach the Top of the Corporate Ladder. Moderated by Chris Kwok, AABANY Board Director and Chair of AABANY’s Issues Committee, the virtual webinar received over 300 registrations from legal and non-legal professionals. Conversation centered around the book’s subject — invisible challenges Asian Americans face when it comes to upward corporate mobility.

Professor Margaret Chin began the panel by articulating the difficulty that Asian American professionals face in moving from mid-level management to the C-suites. Chin has discovered two critical factors that explain why. The first is that Asian Americans are hidden from the research. Only in the past five years has research been done on the corporate mobility challenges facing the Asian American professionals, demonstrating not only the invisibility of Asian Americans in racial discussions but a lack of awareness of the “bamboo ceiling.” The second is trust. Through her interviews with corporate executives, Chin discerned trust as a leading factor in who is and who isn’t promoted. Trust, however, also opens the door for implicit bias. Oftentimes, those who are seen as part of the “in-group” or white are seen as more trustworthy, leaving racial minorities at a disadvantage. 

A Q&A session followed the talk, during which Chris, as moderator, posed questions sent via chat to Professor Chin. One audience member asked Professor Chin what inspired her to write this book. Her answer recounted a class reunion where she realized that while many Asian Americans are admitted to Ivy League and top tier universities, there was no research on their career paths post-education. This reveals the false assumption that once an Asian American achieves an elite education, their career is set. Another question asked Professor Chin for solutions to the lack of upward mobility faced by Asian professionals. To this, she discussed how through her interviews with Asian executives, she discovered the importance of early career resources such as college career offices, formal corporate programs, and other similar programs. These have proven to be particularly helpful to non-white professionals who often do not have strong networks or resources at their disposal. Nonetheless, these are not the only solutions, leading Professor Chin to reiterate the need for more research on the “bamboo ceiling” in order to drive change.

AABANY Presents: Real Estate Closing in the New Norm: The New Rules & Practices

On July 23, AABANY’s Real Estate Committee presented a CLE Program on real estate closings in the COVID-19 era. The panel focused on how the real estate market is adapting to COVID-19 through new rules and practices and detailed the current state of property transactions. Speakers included Jason Wang, Licensed Real Estate Salesperson at COMPASS, Wendy Yu, Counsel at Yu Law, and Jane Chen, Associate at Forchelli Deegan Terrana LLP. The program was moderated by Margaret Ling, co-chair of the committee and Senior Counsel at Big Apple Abstract Corporation.

Margaret Ling began the panel with an update on the current New York state real estate legal landscape. This included the 202 executive order mandate by Governor Andrew Cuomo, declaring a state of emergency to permit only essential businesses. As a result, most real estate showings are now virtual and transactions are digital. Open houses are permitted only if social distancing measures are maintained.

Jason Wang spoke on his experience as a real estate salesperson at the inception of the pandemic and shared market observations. Because of at-home quarantine, buyers have begun to realize what they want in a home property and so there is a continued demand for property. Additionally, residents who fled New York City during the pandemic on-set may return in the near future and strengthen the real estate market.

Wendy Yu then outlined client protection concerns during virtual transactions. This includes taking into account that many buyers are now making offers without ever seeing property in person, emphasizing the need to place buyer protection clauses in contracts. Other considerations involve death clauses, in case that one party is no longer capable of continuing the transaction, as well as maintaining a flexible approach, so that either seller or buyer may be granted extra transaction time in case of pandemic-related challenges.

Jane concluded the panel by providing insight into co-op property transactions. Specifically, co-op boards that typically meet on a regular basis are now meeting less frequently, making it difficult for potential buyers to be interviewed for acceptance. Furthermore, because co-op boards are responsible for serving the interests of all building residents, it is important for interested buyers to keep in mind the visitor restrictions that exist in these communities.

Working Together to Serve Diverse Communities: A Virtual Resource Fair

Nine federal agencies will share information concerning their missions and available programs and resources. This information-packed event offers a roadmap to access federal services, to build stronger relationships, and to explore ways that we can work together to better serve Black, Latino, and other communities of color.
