On Tuesday, March 27, AABANY’s Asia Practice Committee presented a CLE program entitled “Risks and Strategies for Foreign Companies Involved in US Litigation” at Paul, Weiss. The panel included:
- Karen King, Counsel, Paul, Weiss, Rifkind, Wharton & Garrison LLP
- Michael Gertzman, Partner, Co-Head of Litigation, Paul, Weiss, Rifkind, Wharton & Garrison LLP
- Diane Knox, Division General Manager of Legal, Compliance & Logistics, Mitsubishi Corporation (Americas)
- Jian Wu, International Lawyer, Kobre & Kim LLP (moderator)
The panelists provided an overview of litigation in the United States, going from the complaint stage up through trial, using film clips from famous movies to show examples of witness preparation and eliciting expert testimony. A discussion of attorney-client privilege and the work product doctrine took place, with cautionary notes for foreign companies whose home jurisdictions do not recognize such privileges or protections in litigation.
A total of 1.5 credits in Areas of Professional Practice was awarded to attendees. After the CLE concluded, everyone enjoyed a fabulous spread of hors d’oeuvres with drinks and refreshments courtesy of Paul, Weiss.
Thanks to Paul, Weiss for hosting this CLE event, and thanks to all the panelists for an informative and well-presented program.
